Shri H.P. Mishra, learned counsel for the petitioners states that at present, only Notice dated 20th April, 2011, under Section 13 (2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short "the Securitization Act") has been issued to the petitioners and no action / measure has as yet been taken under Section 13 (4) of the Securitization Act against the petitioners, therefore, the petitioners want to withdraw the present Writ Petition, and the same may be dismissed as withdrawn without prejudice to the rights of the petitioners to pursue appropriate remedy as may be open to them under law, as and when any action / measure is taken against the petitioners under Section 13(4) of the Securitization Act.
In view of the statement made, the Writ Petition is dismissed as withdrawn without prejudice to the rights of the petitioners to pursue appropriate remedy as may be open to them under law, as and when any action / measure is taken against the petitioners under Section 13(2) of the Securitization Act.
