The petitioner filed a suit for cancellation of tenders issued by the respondents for the procurement of certain materials along with an application for interim relief. On the application for interim relief notice has been issued to the defendants and 4.7.2011 is fixed for the disposal of the application.
Learned counsel for the petitioner submitted that in case interim order will not be granted the petitioner shall suffer irreparable loss inasmuch as the tenders have been given illegally without adopting the proper procedure.
In view of the aforesaid facts and circumstances, the writ petition is disposed of directing the trial court to dispose of the application on the next date fixed and if it is not possible to dispose of the application on the date fixed in any case the same may be disposed of expeditiously preferably within a period of four weeks in accordance to law. It will be open to the petitioner to move an application before the court concerned for preponing of the date.
