Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Mahesh Narain Singh, learned counsel for the respondent no.4.

The only prayer made by the petitioner is that a writ of mandamus be issued directing the respondent no.1 Commissioner, Bareilly Division, Bareilly to decide the stay application dated 9.3.2011 (annexure no.4) filed by the petitioner in Revision No. 10 of 2000 within a definite period.

To the aforesaid prayer, learned Standing Counsel has no objection provided if some reasonable time is given to the court below to decide the stay application dated 9.3.2011 (annexure no.4) filed by the petitioner in Revision No. 10 of 2000.

Without expressing any opinion on the merits of the petitioner's case, this writ petition is finally disposed of with a direction to the respondent no.1 Commissioner, Bareilly Division, Bareilly to decide the stay application dated 9.3.2011 (annexure no.4) filed by the petitioner in Revision No.10 of 2000 in accordance with law after hearing both the sides and without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
