Heard learned counsel for the petitioner, learned Standing Counsel as well as learned counsel for the management.
Submission of learned counsel for the petitioner is that the committee of management passed resolution dated 13.3.2001 for promotion of the petitioner on the post of Burser in Dharam Samaj Mahavidyalaya, Aligarh and thereafter necessary papers were also forwarded on 24.3.2001 to the Joint Director, Office of the Director, Higher Education, U.P., Allahabad but on objection being raised on account of certain documents the petitioner's promotion has not been approved. His further submission is that the concerned documents were supplied but no decision has been taken up till now. Although dispute has been raised in regard to the constitution of selection committee.
The Court has perused the pleadings of the parties and from the pleadings of the parties it is evident that no such proceedings have been placed on record from which it can be inferred that selection committee was constituted and the constitution of committee has been objected by the respondents.
In absence of any evidence in regard to the constitution of the committee, let the Joint Director, Higher Education, U.P., Allahabad may take a decision in the matter in accordance with the rules within a period of 15 days from today. List after expiry of the aforesaid period.
