Heard learned counsel for the parties and perused the record.
The controversy in question can very well be settled by the concerned executing court in pursuance to the provisions contained in the Code of Civil Procedure. Accordingly, no case of interference under Article 226 of the Constitution of India is made out.
However, in case the petitioner approach the trial court with the appropriate application or in case he had already approached, the same shall be decided expeditiously.
Subject to above, the writ petition stands disposed of.
