Learned standing counsel states that in view of the contradictory interim orders passed by the Lucknow Bench of the Court by which sanction of the mining leases have been stopped on the ground that the State resources must be put into auction as it was done prior to 16.10.2004, whereas Allahabad High Court directed that the applications for grant of mining leases are to be processed, the State Government is not in a position to take a final decision in the matter.
In such a situation, the State Government should have applied for vacating the interim order either at Lucknow or at Allahabad, or to request for referring the matter to the larger bench.
