Heard learned counsel for the petitioner and Mr.D.R.Mishra, learned counsel for the opposite parties 2 and 3.
The petitioner was suspended from service on 6th of July, 2006. He has already submitted reply of the charge sheet on 9th of December, 2010, but till date the inquiry has not been completed. Therefore, the disciplinary authority shall take final decision in the matter within three months from today by concluding the enquiry in the matter either himself or by other competent officer by providing opportunity of oral hearing to the petitioner. Accordingly, the disciplinary proceedings shall be completed within three months, in which the petitioner shall co-operate. In case the proceedings are not completed within three months, after expiry of the aforesaid period, the order of suspension shall stand revoked.
With the aforesaid observations and directions, the writ petition is disposed of finally.
