The petitioner is a senior clerk in the office of Chief Election Officer at Kanshi Ram Nagar. It appears that certain financial irregularities have been found by the Deputy Collector against the petitioner and in respect thereof an inquiry was made and the petitioner has been held liable for Rs.2,50,800/-. By letter dated 10.6.2011, the Deputy District Election Officer wrote a letter to the Chief Election Officer, Lucknow that necessary action be taken against the petitioner and at the bottom of the letter it is mentioned that Rs.2,50,800/- be recovered from the salary of the petitioner.

Learned Counsel for the petitioner submitted that his appointing authority is the Chief Election Officer and Deputy Collector and the Collector have no jurisdiction to make an inquiry and held guilty for financial irregularities and liable for the payment of Rs.2,50,800/- and at the most the available material and the irregularities can be referred to the Chief Election Officer for necessary action.

Learned Standing Counsel submitted that reasonable time be allowed to seek instruction in the matter.
