The contention of the petitioner is that his services have been regularized on 25.5.1995 and he is a Government servant. By the Government Order dated 28.11.2001 the retirement age of the State Government employees has been raised from 58 years to 60 years. Thereafter in exercise of power conferred by the proviso to Article 309 of the Constitution, the Fundamental Rules, 2002 was framed by which the amendment has been made in Fundamental Rules contained in the Financial Handbook Volume-II, parts II-IV which envisages that every Government servant shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years.

Learned Standing Counsel prays that he may be allowed some reasonable time to seek instruction in the matter.
