Learned counsel for the petitioners submitted that the excess payment has been made to the petitioners not due to fraud or misrepresentation on the part of the petitioners and, therefore, the respondents are not entitled to recover the amount, which has been paid in excess.

Learned Standing Counsel prays for and is allowed four weeks' time to file the counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

List in the week commencing 29th August, 2011.

Till the next date of listing, the recovery of the excess amount from the petitioners shall remain stayed.
