First Appeal No.372 of 2009 (Nikhilesh Kumar Mishra Vs. Smt. Jaya Mishra) is a Family Court Appeal, under Section19 of the Family Court Act, arising out of District Kanpur Nagar and is a Division Bench matter.
First Appeal No.370 of 2009 (State of U.P. Vs. Sher Singh) is an appeal under Section 54 of the Land Acquisition Act for reducing the award arising of District Bulandshahar.
In the memo of Appeal No.372 of 2009, an order dated 8.1.2010 is affixed dismissing the appeal for default, however, the title of the case is mentioned as First Appeal No.370 of 2009 (State of U.P. Vs. Sher Singh).
On the application filed in First Appeal No. 372 of 2009, the order in that appeal was corrected (see order of the date on the order sheet of that appeal), however, the order treating this appeal to be dismissed continues in the computer data base of the judgments.
It is clarified that this appeal is not dismissed but is pending. The order dated 8.1.2010 in the computer data base of the judgments be deleted in case no certified copy of that order has been issued otherwise it may be treated as cancelled for this appeal.
