Petitioners' contention is that in the past in writ petition No.46148 of 1999 had been filed before this Court and this Court on 28.11.2000 had asked the competent authority to take decision. Pursuant to the said order of this Court, an order was passed to the effect that the representations of the incumbents would be considered after the orders were passed in Special Appeal, which had been so preferred. Petitioner submits that the Special Appeal preferred by State Government had been dismissed on 07.05.2003 in the case of State of U.P. vs. Gajadhar Pandey reported in 2003 (1) ESC page 221. Petitioner further submits that the said decision of this Court has been affirmed in S.L.P. by Apex Court in State of U.P. vs. Gajadhar Pandey. Petitioner submits that once in the past order had been passed on 15.03.2001 that the orders would be passed on the representation after Special Appeal was decided, then in such a situation and in this background, the respondents should be directed to take decision on the representation which had been so moved by t he petitioners.
Consequently, in the facts of the case, without interfering with the termination order passed in 1973, the respondents are directed to take decision on the representation which had been so moved by the petitioners, in accordance with law, within a period of four months from the date of receipt of a certified copy of this order.
Writ petition stands disposed of accordingly.
