On account of a vacancy having fallen vacant in the institution namely, Janta Intermediate College, Mau-Aima, Allahabad, the process for making a care-taker Principal was initiated. The petitioner claims that he was the senior most lecturer in the institution in question and was eligible to be appointed against the said post. His plea was rejected by the respondents on the ground that he had concealed the fact that he was in custody in the year 1995. As on today a Principal has been appointed in the institution substantively, as such, the prayer of the petitioner has become infructuous.
In view of the changed circumstances, the writ petition has become infructuous. Accordingly, the writ petition is dismissed as infructuous.
Petitioner claims that he has not been paid his salary for a period of four month i.e. w.e.f. 25.8.2008 to December 2008. Respondent no. 6, management of the institution, is directed to examine this issue and pass appropriate orders after hearing the petitioner. In case, the same is due under the rules, the petitioner shall be paid his salary. Let this process be completed within a period of two months from the date a certified copy of this order is produced before respondent no. 6.
