It has been stated on behalf of the petitioner that in the present case plantation had been carried out and thereafter it appears that with the passage of time some of the plants have been found missing, and in this background show cause notice had been issued to the petitioner, to which the petitioner submitted his reply. Grievance of the petitioner is that reply submitted by him has not been considered in its correct perspective, and the order has been passed directing for recovery from the petitioner, as such order is bad for the simple reason that reply submitted by the petitioner has not been considered in its correct perspective.
The arguments advanced by the petitioner require consideration by this Court, as such till the next date of listing, the amount sough to be recovered from him in pursuance of the impugned order shall not be recovered from the petitioner.
