This Special Appeal arises out of judgment dated 8.4.2008, by which this Court found that earlier a direction has already been issued to decide petitioner's representation for payment of salary within three months. Fresh directions are not required to be issued.
It is submitted that since no Scheduled Caste candidate was available, the vacancy was filled up by the petitioner belonging to general category, and that his appointment was subsequently approved by the Deputy Director of Education after this Court had directed his representation to be decided.
The petitioner is claiming salary since 1991. There is nothing on record to show whether the petitioner is still working in the institution, and the circumstances, in which he is teaching for last 20 years, without getting any salary.
Let learned Standing Counsel file an affidavit of the District Inspector of Schools after making enquiries from the institution that the petitioner is actually working and discharging duties since the date of his appointment. He will also report, if there has been any break in his service.
The supplementary affidavit will be filed within three weeks.
List on 9.1.2012. Let a certified copy of the order be given to Chief Standing Counsel for compliance.
