HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 38 Case :- WRIT - C No. - 69644 of 2011 Petitioner :- Anoop Das (Minor) Respondent :- Union Of India And Others Petitioner Counsel :- Harikesh Kumar Gupta,Abhishek Srivastava Respondent Counsel :- C.S.C.,A.S.G.I.(2011/2410),U.S. Upadhyay Hon'ble Rajes Kumar,J.
The petitioner is seeking a direction to respondent nos. 5 and 6 to take admission of the petitioner in Class-11.
The Behnur Public School, Pilibhit is a private school. It is not aided by the Government and is affiliated to the C.B.S.E. Board, New Delhi.
The contention of the petitioner is that since the Behnur Public School, Pilibhit is affiliated to the C.B.S.E. Board and for the irregularities being committed in the admission by the school, the C.B.S.E. Board has the right to intervene and, therefore, the writ petition against respondent no. 6 is maintainable.
Sri U.S. Upadhyay, learned counsel appearing for the C.B.S.E. Board submitted that the C.B.S.E. Board has no role in the admission of the school. The Board is concerned to conduct the examination of the candidates whose applications are referred by the school.
Learned counsel for the petitioner requested that the matter may be taken up on 7.12.2011 to enable him to look into the matter.
Put up on 7.12.2011 as fresh.
