Learned counsel for the petitioner submitted that on the basis of the ex-parte inquiry report, the impugned order has been passed by the District Basic Education Officer, Muzaffar Nagar. He further submitted that no opportunity whatsoever has been given before passing the order. The District Basic Education Officer, Muzaffar Nagar has passed the impugned order, has been made party as respondent no. 5, but the notice has not been served upon respondent no. 5.
Learned counsel for the petitioner requested that the matter may be taken up on 7.12.2011 to enable him to serve the copy to respondent no. 5.
