The petitioner has prayed for quashing the order dated 7.9.2011 passed by the Armed Forces Tribunal, Regional Bench, Lucknow.

The petitioner has a right to appeal under Section 30 of the Armed Forces Tribunal Act, 2007 to the Supreme Court.

Col. (Retd) R.A. Pandey, Learned Counsel appearing for the petitioner submits that in view of Section 14 saving the jurisdiction of the High Court under Articles 226 and 227 of the Constitution of India a writ petition for judicial review of the judgment of the Armed Forces Tribunal is maintainable in the High Court.

The matter requires consideration.

List on 10.1.2012 for hearing on the question, whether the writ petition under Article 226 of the Constitution of India against the final order of the Armed Forces Tribunal is maintainable.
