The petitioner has been appointed as Seasonal Collection Amin on 20.7.2011. The appointment of the petitioner has been cancelled on the ground that by 26.7.2011, the petitioner could not appear to collect the receipt bahi and to provide service and in his place one Sri Chandra Pal has been appointed.
Learned Standing Counsel is not able to show up to what period the petitioner has to appear before the authority concerned after the appointment.
It appears that no show cause notice has been given before the cancellation of the appointment of the petitioner.
The contention of the petitioner requires consideration.
Learned Standing Counsel may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the operation of the order dated 26.7.2011 shall remain stayed. The petitioner is directed to appear before the Tehsildar/Sub-Divisional Magistrate, Saharanpur within a period of one week along with certified copy of this order.
