The petitioner is challenging the order dated 20.4.2011, which has been served upon the petitioner on 29.6.2011 by which the services of the petitioner as Seasonal Collection Amin have been dispensed with on the allegation that the petitioner have recovered a sum of Rs.83,187/- along with collection charges without issue of recovery certificate.

Learned counsel for the petitioner submitted that by the action of the petitioner, no loss has been caused to the Revenue. Since the person concerned was prepared to deposit the money, the same has been received and receipts have been issued. He submitted that the petitioner had earlier filed writ petition and annoyed with the filing of the said writ petition, the impugned order has been passed.

There appears to be substance in the argument of learned counsel for the petitioner.

The matter requires consideration.

Learned Sanding Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

List thereafter.

Till the next date of listing, the operation of the order dated 20.4.2011, so far as the petitioner is concerned, shall remain stayed.
