Learned counsel for the petitioner states that the petitioner is a daily wager and claiming the pay-scale of Rs.4440-7400/- on the ground of parity as being paid to the employees at the office of the Advocate General of Lucknow Bench. The list of such persons is Annexure-11 to the writ petition.
Learned Standing Counsel is directed to file counter affidavit on the following points :
(i) That under which Rule and following which procedure having regard to Articles 14 and 16 of the Constitution of India these persons have been appointed at the office of the Advocate General of the Lucknow Bench and what is their status.
(ii) If they are daily wagers/temporary employees or ad hoc employees and are getting the pay-scale of Rs.4440-7400/-, why the petitioner, being daily wager, is being denied of such pay-scale.
