It has been sough to be contended on behalf of the petitioner that he has been performing and discharging duties as Principal of Sarvajanik Sewashram Sanskri Mahavidala, Raja Ka Sahaspur (Bilari) Mordabad. Petitioner has further proceeded to mention that the District Inspector of Schools without verifying this fact as to whether Brijesh Kumar Singh has been appointed in accordance with law, strictly as per provisions contained in Chapter III Of the U.P. Madhyamik Sanskrit Shiksha Parioshad Adhiniyam, 2000, has proceeded to ask the petitioner to hand over the entire record qua his appointment. Petitioner submits that once Brijesh Kumar Singh has not been appointed in consonance with law, rather his engagement has been made at the whims of the Manager of the institution, then the District Inspector of Schools could not have given such direction for handing over the papers in relation to said Brijesh Kumar Singh.
Prima facie the argument advanced appears to have substance and the raised requires investigation by this Court, as such till the next date of listing, petitioner shall not be compelled to hand over the records as directed by the District Inspector of Schools.
