By the impugned order, excess amount paid is being realized. It is the contention of the petitioner that no case of misrepresentation or fraud has been made out and, therefore, the realization of the excess amount, if any, is not justified.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the realization of the excess amount in pursuance of the impugned order dated 3.6.2011 shall remain stayed.
