Heard learned counsel for the petitioner and learned Standing Counsel for the State.
The only prayer made by the petitioner is that a writ of mandamus be issued directing the respondent no.2 Deputy Commissioner (Food), Lucknow Division, Lucknow to decide the Appeal No. 695 of 2008-09 under Section 28(3) Uttar Pradesh Essential Commodities Distribution Order, 2004 within a definite period.
To the aforesaid prayer, learned Standing Counsel has no objection provided if some reasonable time is given to the court below.
Without expressing any opinion on the merits of the petitioner's case, this writ petition is finally disposed of with a direction to the respondent no.2 Deputy Commissioner (Food), Lucknow Division, Lucknow to decide the Appeal No. 695 of 2008-09 under Section 28(3) Uttar Pradesh Essential Commodities Distribution Order, 2004 after hearing both the sides and without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
