Challenging the recovery proceedings of House Tax with respect to House No.553/461B Colonelganj, Allahabad, the present writ petition has been filed.
Shri S.P.Kesarwani, learned counsel appearing on behalf of the respondent has took a very fair stand that the Nagar Nigam shall redecide the matter in the light of the objection raised by the petitioner.
In this view of the matter, we dispose of the writ petition by providing that the Nagar Nigam may redecide the matter in the light of the objection raised by the petitioner. The recovery certificate is hereby quashed. After assessment, a fresh recovery certificate may be issued. The proceedings may be completed expeditiously preferably within a period of one month.
With the aforesaid observation, the writ petition is disposed of.
