The trial court has fixed the maintenance allowance at Rs.3,000/- per month after assessing the income of the petitioner at Rs.10,000/- per month. The case of the petitioner is that he is an employee in a firm M/s. Shubhanjay Metal Stores, Kanpur Nagar and getting only Rs.3,000/- per month and, therefore, the petitioner is not able to pay a sum of Rs.3,000/- per month.
Issue notice to the respondent, returnable at an early date. The petitioner may take steps to serve the respondent within a week.
List in the week commencing 11.7.2011.
Till the next date of listing, the operation of the order dated 16.3.2011 shall remain stayed provided the petitioner pays a sum of Rs.2,000/- per month to the respondent-wife.
