After the matter has been heard at some length, this Court is of the opinion that the Government Order dated 30.09.1981, reference of which has been given on page 31 of the paper book, be produced, and further learned standing counsel should also seek specific instructions on the issue as to whether State Government at any point of time has delegated its authority upon Director General, Medical and Health Services, Lucknow for according relaxation in terms of Rule 24 of 1980 Rules.
List this case on 03.05.2010.
Since hearing is on going and under the orders, which are subject matter of challenge, recovery has been ordered against the petitioner, as such it is hereby directed that no recovery shall be pressed against the petitioner till decision of present writ petition.
