Heard learned counsel for the applicant and learned AGA.
It has been submitted by the learned counsel for the applicant that neither the applicant nor Irshad were named in the FIR. However, their names surfaced during investigation and from their joint possession, motorcycle was recovered. It has been submitted that co-accused Irshad has already been granted bail by the learned Additional Sessions Judge vide order dated 20.10.2010.
Considering the facts and circumstances of the case, the accused applicant also deserves bail.
Let applicant Mohammad Asim involved in case crime no.178 of 2010 under Sections 392/411 IPC, P.S. Kundarki, District Moradabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
