Heard learned counsel for the applicant and learned AGA.
Supplementary affidavit filed today is taken on record.
The applicant is in jail since 7.3.2010. This Court by order dated 24.2.2011 had required the learned AGA to inform as to whether any handwriting expert opinion has been obtained with regard to the signature of applicant on the alleged deed.
In the supplementary affidavit filed today in para 5 it has been specifically averred that no verification was obtained from any handwriting expert with regard to the alleged signature of the applicant. Further the charge sheet has been submitted which does not disclose that any handwriting report has been made part of the evidence. It is also submitted that Girish Agarwal other co-accused who has actually taken loan, had made some deposits with regard to the alleged loan.
Considering the facts and circumstances of the case, the accused applicant deserves bail.
Let applicant Krishna Kumar Singh involved in case crime no.451 of 2009 under Sections 467, 468, 471, 419, 420, 120-B IPC, P.S. Rakabganj, District Agra be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
