The Central Government notified the transfer of Justice Joymalya Bagchi back to the Calcutta High Court from Andhra Pradesh High Court.
Notification issued by Ministry of Law stated that,
"In exercise of the powers conferred by Clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Shri Justice Joymalya Bagchi, Judge of Andhra Pradesh High Court, as a Judge of Calcutta High Court and to direct him to assume charge of his office in the Calcutta High Court."
Last year, the collegium had recommended transferring Justice Bagchi from Calcutta to Andhra Pradesh High Court on December 14, 2020.
On September 16, the collegium headed by Chief Justice of India N V Ramana had recommended the “re-transfer” of Justice Bagchi to his parent HC. The collegium did not provide any reasons for the transfer. The recommendation came nine months after Justice Bagchi was transferred to Andhra Pradesh HC. The collegium had recommended his transfer from Calcutta HC on December 16, 2020, amid controversy at the time over allegations by Andhra Pradesh Chief Minister YS Jagan Mohan Reddy that a senior Supreme Court judge was interfering in the functioning of Andhra Pradesh HC.
Now, he is back to his home High Court as per the notification dated 25th October 2021.
