The Division Bench of the Allahabad High Court, comprising Justice Attau Rahman Masoodi and Justice Om Prakash Shukla in the case of Dr. Shailendranath Mishra vs. Union Of India has dismissed the PIL related to determination of real date of birth of Tulsidas.
The petitioner has filed PIL to determine and establish the birthplace of the revered Hindu saint and the author of Ramcharitmanas, Mahakavi Goswami Tulsidas.
The Bench perused the facts of the case and expounded that the question raised in PIL involved, is essentially academic upon which the petitioner himself is uncertain and the reliance placed upon by the petitioner upon any textbook having no legal sanctity cannot lead us to opine one way or the other.
Therefore, the Court dismissed the petition without prejudice to the remedy of declaration sought if any.
