Pepsu Road Transport Corporation Rules, 1977

No. GSR13/CA64/50/S.44/77. - In exercise of the powers conferred by section 44 of the Road Transport Corporations Act, 1950 (Parliament Act No. 64 of 1950), the Governor of Punjab is pleased to make the following rules, namely :-
- Short title.- These rules may be called the Pepsu Road Transport Corporation Rules, 1977.
- Definitions.- In these rules, unless there is anything repugnant in the subject or contexts, -
(a) "Act" means the Road Transport Corporations Act, 1950 (Parliament Act 64 of 1950);
(b) "Chief Accounts Officer" means the officer appointed by the State Government as the Chief Accounts Officer of the Corporation under sub- section (1) of section 14 of the Act :
[(bb) "Financial Adviser" means an officer appointed by the State Government as the Financial Adviser of the Corporation under sub-section (1) of section 14 of the Act]
[(c) "Managing Director" means an officer appointed by the State Government as the Managing Director of the Corporation under sub-section (1) of section 14 of the Act.]
(d) "General Manager" means the officer appointed by the State Government as the General Manager of the Corporation under sub-section (1) of section 14 of the Act; and
(e) "Regulations" means the Regulations made by the Corporation under clause (c) of sub-section (2) of section 45 of the Act.
Chapter II
Constitution of the Board
- Constitution.- [The Corporation shall consist of seven members including the Charman, out of which sex shall be official members.]
(2) Four members including the Chairman shall be nominated by the State Government as its representatives and the fifth member shall be nominated by the Central Government as its representative. The State Government or the Central Government may appoint one or more of its representatives to be whole-time members of the [Board].
- Salary and allowances payable to Chairman and Members.- Officials appointed as whole time members shall be entitled to such salary and allowances as may be specified by the State Government, Officials appointed as part time members shall not be entitled to any salary or allowance except as provided in sub-rule (1) of rule 5. [-]
- Travelling and daily allowance.- (1) An official appointed as Chairman or member shall be entitled to draw such travelling and daily allowance as may be admissible to him by virtue of his office under the State Government or the Central Government, as the case may be :
Provided that he shall not draw travelling or daily allowance admissible under these rules if for the same journey or for the same day he has drawn travelling or daily allowance, as the case may be, from the Government.
(2) The travelling and daily allowance of a non-official appointed as Chairman or member shall be governed by such rules as are applicable to a Punjab Government employee in receipt of similar remuneration.
(3) The Corporation may provide a staff car for the use of the Chairman for the discharge of his duties under the Act; and where the Chairman uses such staff car for any journey no travelling allowance shall be paid to him in respect of that journey.
- Medical facilities.- A whole-time Chairman or member and members of the family of such Chairman or member shall be entitled to such medical facilities as are admissible to a Punjab Government employee in receipt of similar remuneration.
- Accommodation facilities.- A whole-time Chairman or members residing at the headquarters of the Corporation shall be entitled to residential accommodation owned or requisitioned by the State Government or residential accommodation owned by the Corporation, if and when available, on payment of ten per cent of his emoluments, subject to the condition that in case of State Government owned or requisitioned accommodation the difference of rent worked out under rule 45-B of the Fundamental Rules and that actually paid by the Chairman or member, as the case may be at ten per cent of his emoluments, shall be paid to the State Government by the Corporation.
[8. Leave. - (1) The officer appointed as whole-time Chairman or member shall be entitled to such kind of leave, including casual leave, as is admissible to him under the provisions of service rules applicable to him.
(2) The power to grant leave to the Chariman and power to grant leave, other than casual leave, to the members shall vest in the State Government and the power to grant casual leave to the members shall vest in the Chairman.]

- Whole-time members to accept any other assignment.- No whole-time Chairman or member shall during the tenure of his office accept any assignment, other than that of the Corporation, without the prior permission of the State Government.

- Casual vacancies.- All casual vacancies among the members shall be filled up as soon as conveniently may be in the manner provided in rule 3.
- Quorum.- The number of members necessary to constitute a quorum at a meeting of the [Board]
Chapter III
General Manager and the Chief Accounts Officer
- Pay and allowances.- (1) The General Manager shall be entitled to pay in the scale of Rs. 400-30-550/40...750/50-1,250 :
Provided that a Government employee on deputation with the Corporation shall, at his option, be allowed either the pay admissible to him from time to time in his parent department plus twenty per cent deputation allowance or pay in the aforesaid scale.
(2) The General Manager shall be provided with a staff car or in lieu thereof a monthly conveyance allowance of one hundred rupees. He shall also get dearness allowance at the rate admissible to a Government employee drawing the same day.
[(3) The Chief Accounts Officer shall be entitled to pay in the scale of Rs. 1,400- 60=1,700/75-2,000/100 2,400, along with usual allowances :
Provided that he is an associate of the Institute of Chartered Accountants of India, of an associate of the Institute of Costs and Works Accountants of India or a Master of Business Administration with specialisation in Financial Management having at least three year's experience in maintenance of accounts or preparation of budget and balance-sheet or auditing and financial management in a Government or a semi-Government or a Private reputed commercial concern; or Chief-Accounts Officer of the Finance Department:
Provided further that a Government employee on deputation to the Corporation shall be allowed pay admissible to him from time to time in his parent department plus deputation allowance as sanctioned by the State Government from time to time. He shall also get dearness allowance at rate admissible to a Government employee drawing the same pay.]
(4) Where a Government employee is on deputation with the Corporation as General Manager or Chief Accounts Officer, the Corporation shall pay for the period of deputation to the Government leave and pension contribution at such rates as may be specified by the Government.
- Travelling allowance.- The General Manager and the Chief Accounts Officer shall be entitled to such travelling allowance for the journey performed for the discharge of duties under the Corporation as may be admissible to a Government employee enjoying the same pay and status :
Provided that no travelling allowance shall be paid to the General Manager if he performs the journey by staff car.
- Leave and leave salary.- The General Manager or the Chief Accounts Officer who-
(a) is a Government employee and is on deputation with the Corporation shall, so long as he remains in Government service, be entitled to leave and leave salary under the rules applicable to him as such Government employee and
(b) is not a Government employee, or being in the Government service has subsequently ceased to be in such service, shall be entitled to such leave and leave salary as is admissible to other employees of the Corporation under the Regulations.
- Provident fund.- The General Manager or the Chief Accounts Officer who-
(a) is a Government employee and is on deputation with the Corporation and who has been admitted to the provident fund maintained by the Government shall, so long as he is in Government service, be entitled to continue to subscribe to the said fund in accordance with the rules applicable to Government employees :
(b) is not a Government employee, or being in Government service has subsequently ceased to be in such service, shall be entitled to the benefit of the contributory provident fund of the Corporation under the Regulations.
- Termination of service.- Except as otherwise expressly provided by the terms of a contract in any individual case, the State Government may terminate the services of the General Manager or the Chief Accounts Officer who is not a Government employee, by giving him six months' notice.
- Resignation.- Except as otherwise expressly provided by the terms of contract in any individual case, the General Manager or the Chief Accounts Officer who is not a Government employee, may resign his office by giving three months' notice in writing to the State Government.
Provided that if the State Government so directs, the General Manager or the Chief Accounts Officer, as the case may be, giving such notice shall not vacate his office unless he is relieved thereof.
- Disciplinary action.- The General Manager or the Chief Accounts Officer, who-
(a) is a Government employee and is on deputation with the Corporation, so long as he is in Government service, shall on the recommendation of the Corporation be subject to disciplinary action by the State Government according to the rules applicable to Government employees;
(b) is not a Government employee or being a Government employee has ceased to be in Government Service shall be subject to disciplinary action by the Corporation under the Regulations.
- Other conditions of service.- All other matters relating to the conditions of service of the General Manager or the Chief Accounts Officer who -
(a) is a Government employee on deputation with the Corporation shall be regulated in accordance with the provisions of the Punjab Civil Services Rules; and
(b) is not a government employee or being a Government employee has ceased to be in Government service, shall be regulated in accordance with the provisions of the Regulations.
- Repeal.- The Pepsu Road Transport Corporation Rules, 1955, are hereby repealed:
Provided that anything done or any action taken under the rules hereby repealed shall be deemed to have been done or taken under the corresponding provisions of these rules.
