The Maharashtra Electrical Energy (Regulation of Distribution, Supply, Consumption or Use) Order, 1995

Whereas it has become necessary to conserve electrical energy, it is deemed expedient to control distribution, supply, consumption and organized use thereof;
Now, therefore, in exercise of the powers conferred by section 6-A and 6-B of the Bombay Electricity (Special Powers) Act, 1946 (Bombay XX of 1946) and all other powers enabling in that behalf and in supersession of Government Order, Industries, Energy and Labour Department, No. SAC. 1072/Elec. II, dated 4th October, 1972 as amended from time to time. Government Order, Industries, Energy and Labour Department, Order No. SAC. 1977/2605/NRG-2, dated 18th February, 1978 so far as it relates to Maharashtra State Electricity Board, the Government of Maharashtra hereby makes the following order namely :-
- Short title and commencement.- (1) This Order may be called the Maharashtra Electrical Energy (Regulation of Distribution, Supply, Consumption or Use) Order, 1995.
(2) It shall come into force with effect from 1st December, 1995.
- Definitions.- In this Order, unless the context requires otherwise,-
(a) "consumer" means a consumer or a group or class of consumers.
(b) "licensee" means Maharashtra State Electricity Board constituted under section 5 of the Electricity (Supply) Act, 1948.
(c) "week" means a week commencing on Sunday the 26th November, 1995.
(d) "schedule" means a schedule annexed to this order.
- Staggering of supply of electrical energy to consumers.- Depending on the availability of electrical energy and subject to the exemption provided in clause (5), Maharashtra State Electricity Board shall not distribute or supply electrical energy corresponding to the shortfall in the district specified against it in column (2) of the schedule on the day of every week specified against each district in column (3) thereof to achieve saving in the demand upto the registered demand :
[Provided further that nothing contained in this Order shall apply to the consumption of electrical energy for purposes of (i) Coal Mines.]
- Power of licenseee to discontinue supply to defaulting consumers.- Where any consumer consumes or uses electrical energy in contravention of the provisions of clause (3) of this Order, the State Government hereby directs that the licensee shall discontinue forthwith the supply of electrical energy for a period not exceeding 3 days, in the case of consumers receiving supply at 3 phase 400 volts for motive power load end for one day in the case of consumers receiving supply at voltage exceeding 400 volts (H.T.).
- Exemption.- Noting contained in clause (3) shall apply to -
(a) in relation to the distribution of supply of electrical energy by the Maharashtra State Electricity Board to, or use or consumption thereof in the area of Municipal Corporations and other district headquarter towns to any consumer, for purpose of -
(1) Defence purposes (including Military Aerodromes and Aerodromes for military purpose, workshops, wireless installations, hospitals, etc.).
(2) Government Defence Factories.
(3) Water-works and Drainage.
(4) Hospitals.
(5) Posts and Telegraphs including workshops (including "relay stations" and "Central Telegraphs Offices" of Overseas Communications Service and "Monitoring Stations" of Wireless Planning and Co-ordination Wing).
(6) Police Wireless Units.
(7) All India Radio.
(8) Railway installations (including workshops).
(9) Ports and Harbours.
(10) Police Transport Workshops.
(11) Civil Aerodromes.
(12) Government Roadways Workshops.
(13) Meteorological Observatories.
(14) Government Printing Presses.
(15) Power Houses Stations.
(16) Atomic Energy Establishment.
(17) Oil Refineries.
(18) Civil Defence Organisations.
(19) Newspaper Printing Presses.
(20) Dairies.
(21) India Government Mint.
(22) Central Water and Power Research Station, Poona.
(23) Fertilizer Factories.
[(24) Cold Storage Plants for preservation of foods, fruits, feeds and medicines].
(25) Educational Institutions.
(26) Petrol Pumps.
(27) Cinemas and Dramatic theatres.
(28) Consumers who have been working throughout the week that is for seven days of the week prior to 1st December, 1995 either due to their process being continuous or due to any other reasons.
