Constitution Bench rejects Centre’s plea to wait for GST Bill passage
A nine-judge Bench of the Supreme Court has commenced the hearing on the issue of validity of separate Entry Taxes on Goods as provided under different State Government statutes.
Bench gave no ear to the plea of the Centre Govt. to wait for the passage of GST Bill now struck in Parliament.
Chief Justice T.S. Thakur heading the Constitution Bench refused to defer the hearing when Attorney General Mukul Rohatgi submitted that Bench should wait till the fate of the pending GST (Goods and Services Tax) Bill is ascertained.
The Bench includes Justices A.K. Sikri, S.A. Bobde, Shiva Kirti Singh, N.V. Ramana, R. Banumathi, A.M. Khanwilkar, D.Y. Chandrachud and Ashok Bhushan.
It decided to go ahead with the hearing, because “complex tax issues are involved including the past levies by the States.”
State Governments impose Entry Tax on movement of goods from one State to another and is levied by the State that receives the goods.
