Supreme Court: Voters have a Legal Right to know Educational qualification of candidates


Supreme Court has expounded that, “Voters have a fundamental right to know the academic qualification of the candidate and also whether there are any false declaration that can warrant rejection of nomination papers”.

Apex Court Bench comprising of Justice A R Dave and Justice L Nageswara Rao further enunciated that, “It is clear from provisions of the Act, Rules and Form 26 that there is a duty cast on candidates to give the correct information about their educational qualifications,”.

Apex Courts verdict has come on cross appeals filed by Prithviraj Singh and Sharatchandra Singh against each other challenging the judgment of High Court of Manipur.

High Court of Manipur had declared as “void” the election of Prithviraj, who had contested the 2012 polls on a Nationalist Congress Party ticket against Congress nominee Sharatchandra in Manipur.

It was alleged that Prithviraj, in his nomination papers, had stated that he was an MBA, which was found to be incorrect.

While upholding the verdict of High Court , Justice Nageshwar Rao, expounded that it was not “in dispute that the Appellant did not study MBA in the Mysore University” and thus the plea that it was a “clerical error” cannot be accepted.
