Supreme Court: Compensation to Jailed Accused post Acquittal will open flood gates of such pleas


On Tuesday, Supreme Court refused to admit a plea for compensation by six persons for their wrongful arrest and prosecution in the 2002 Akshardham Terror Attack case.

Apex Court expounded that  granting of compensation to the acquitted persons would set a bad precedent and will open the floodgates for such pleas.

Gujarat Government said that the judicial order in favour of the acquitted persons would seriously demoralise the Police, Senior Advocate. Senior Advocate, K.T.S. Tulsi who is representing the six persons, chose to withdraw the petition though proposing instead to file a case of malicious prosecution against the Gujarat Police.

Supreme Court on May 16, 2014 while acquitting them, expounded that “story of the prosecution crumbles down at every juncture”.

More than 30 lives were lost in a terror attack on the Akshardham Temple Complex in Gandhinagar in 2002.

 Mufti Abdul Qayyum Mansuri and Adam Ajmeri, Shan Miya alias Chand Khan had been awarded death sentence on July 2006 by the Special Court set up to try the cases under Prevention Of Terrorism Act.

The other three acquitted persons Mohammed Salim Shaikh was sentenced to life imprisonment, Abdulmiyan Qadri was given a 10-year term, and Altaf Hussain was sentenced to five years.
