SC reserves order on plea challenging discharge of Senior BJP leaders in Babri Masjid demolition Chargesheet

Bench is contemplating a timebound day-to-day trial in this 25 Year old Case.

On Thursday,  Supreme Court reserved its order on the CBI’s petition seeking restoration of the conspiracy charges against the BJP leaders including L K Advani, MM Joshi & Uma Bharti in Babri Masjid demolition case.

The apex court‘ll also decide if trial of the VVIP accused can actually be transferred from a court in Rae Bareli to a court in Lucknow.

There were 2 sets of cases relating demolition of the disputed structure on 6th December 1992. The 1st involved the unnamed ‘karsevaks’, the trial which is taking place in a Lucknow court, while the 2nd set of cases relates to the VVIPs in a Rae Bareli court.

The SC bench comprising of Justice P C Ghose & Justice R F Nariman, indicated that they might order holding a joint trial of these 2 sets of cases by transferring trial from Raebareli to Lucknow.

Bench also said that since twenty five years have already passed, in the interest of justice it’ll consider ordering a time bound trial on the day-to-day basis, to be completed preferably within 2 years.

Senior adv. KK Venugopal, appearing for LK Advani &  Joshi, blatantly opposed this proposal for holding joint trial & transferring the case to Lucknow.

Senior adv. Kapil Sibal, appearing for 1 of the intervenors, supported the proposal of a joint trial, contending the 2 sets of cases had arisen from 1 incident which allegedly involved single conspiracy.

Apex court also gave opportunity to all parties to file their written submissions by Tuesday.




Besides BJP leaders LK Advani, Joshi & Uma Bharti, conspiracy charges were dropped against Kalyan Singh (Governor of Rajasthan), Shiv Sena’s supremo Bal Thackeray & VHP leader Acharya Giriraj Kishore (both have died).
