SC holds Chamber hearing and dismisses Kerala’s curative petition in Soumya Rape Case


In this case contempt notice was issued against Former Apex Court Judge Justice Markandey Katju, who had criticised the verdict.

Supreme Court has dismissed a curative petition filed by Kerala Government challenging dropping of the murder charge against convict Govindachamy in the sensational Soumya rape case.

Apex Court’s six judge Bench headed by Chief Justice J S Khehar expounded that,”Having gone through curative petitions and relevant documents, in our considered opinion, no case is made out within parameters indicated in decision of this court … The curative petitions are, accordingly, dismissed”.

Order was passed yesterday during the in-chamber proceedings in which lawyers do not participate.

Besides CJI Khehar, Apex Court Bench comprising of Justice Dipak Misra, Justice J Chelameswar, Justice Ranjan Gogoi, Justice P C Pant and Justice U U Lalit considered matter in-chamber.

Incident had taken place when Soumya, an employee of a Kochi shopping mall, was travelling in a ladies coach on Ernakulam-Shoranur passenger train on February 1, 2011. She was attacked and pushed off train by Govindachamy, as stated by Prosecution.

Prosecution had further stated that man jumped off the train, carried injured woman to a wooded area near the track at Vallathol Nagar and then raped her. She later had succumbed to injuries at Government Medical College Hospital, Thrissur, on February 6,2011.


Apex Court’s three-judge bench of Justice Gogoi, Justice Pant and Justice Lalit had on September 15,2016 dropped murder charge against the convict, but had upheld life term for raping the 23-year-old sales representative in Kerala.

Verdict had left the victim’s family in shock. They had dubbed it as “heart breaking”, saying it was the “failure” of State Prosecutor to “properly” present case in the Court.
