SC to Asaram’s Trial Court: Do not Linger on the case, Two Witnesses have already been Murdered

Expedite recording of the evidence in Asaram case, Bench asked.

On Wednesday, Supreme Court asked Gujarat trial court to expedite the recording of the evidence of the prosecution witnesses in sexual assault case lodged by the two Surat based sisters against the self-styled godman Asaram.

Apex Court Bench comprising of Chief Justice J.S. Khehar and Justice D.Y. Chandrachud and Justice S.K. Kaul expounded that the trial court to record testimonies of the 46 remaining prosecution witnesses, including the alleged rape victims.

“Trial Court is directed to expedite examination of the witnesses as expeditiously as may be practically possible,” Apex Court Bench added.

Additional Solicitor General Tushar Mehta said this was the same case in which two prosecution witnesses were killed. Twenty-nine prosecution witnesses were examined and the recording of evidence of 46 others was pending.

Supreme Court Bench enunciated that,“Don’t linger it. This is what we want to say to you [Gujarat]. Expedite recording of evidence,”.

Apex Court has fixed the plea filed by Asaram for further hearing in the July third week.

Superme Court has earlier refused to grant bail to Asaram on the various grounds, including his poor health in two separate sexual assault cases lodged in Rajasthan and Gujarat.

Gujarat Government had told the Apex Court that the rape case registered against Asaram would very likely proceed in expeditious manner and trial would be completed within the period of six months.

Two Surat sisters had lodged separate complaints against Asaram and his son Narayan Sai, accusing them of rape and illegal confinement, among the other charges.

Asaram was arrested by the Jodhpur Police on August 31, 2013 and has been in the jail since then.
