These rules may be called the Punjab Silkworm Seed Control Rules, 1957.
In these rules, unless there is anything repugnant in the subject or context :-

(a) "Act" means the Punjab Silkworm Seed Control Act, 1953.

(b) "Disease-Free Silkworm Seed" means Silkworm eggs which are free from all diseases;

(d) "Chawki" means young silkworms hatched from the silkworm eggs and reared until the worms passed the second moult;

(e) "Chawki Rear" means a person rearing Chawkis for distribution amongst Sericulturists;

(f) "Graineur" means a person who is engaged in the manufacture, distribution or disposal of silkworm eggs used for purposes of rearing silkworms and who holds a licence under the Act;

(g) "Grainage" means a place where disease-free silkworm seed is produced;

(h) "Licensing authority" means Superintendent of Sericulture, Punjab.

(i) The Licensing Authority may, after satisfying itself as to the eligibility of the applicant as a graineur and to the needs of the locality or area in which the applicant seeks to be permitted to carry on his silkworm seed operations grant the license which shall be in form 'C'. The Licensing authority may refuse to grant a licence if it is not satisfied as to the eligibility of the applicant or if, in its opinion, the area is adequately served by the existing grainages.

(ii) An applicant for a licence under sub-rule (i) for carrying on silkworm seed operations should possess the following qualifications :-

(a) He should have undergone training for 6 months in a Government Grainage in grainage technique and have practical experience of six months in field work. He should hold a certificate granted by the Superintendent of Sericulture, Punjab Sujanpur; and

(b) He should have sufficient experience of rearing pure foreign races of worms and possess adequate facilities for getting a continuous supply of foreign race seed cocoons.

(iii) An appeal against the orders of the Licensing Authority under sub-rule (i) shall lie with the Punjab Government in the Industries Department. The decision of the appellate authority on such appeal shall be final.

Every person licensed under Rule 3 shall comply with the following conditions:-

(a) He shall prepare disease free silkworm seed only from silkworm seed cocoons approved by and secured through an officer of the Sericulture Organisation of the Department of Industries, Punjab, in the silkworm seed area. In token of his having purchased approved seed cocoons the graineur shall obtain a certificate in form 'C' from the Officer through whom the seed cocoon are procured and this certificate shall also entitle the graineur to transport the seed cocoons from the source of supply of the graineur's place of grainage.

(b) He shall prepare disease-free silkworm seed according to the "Pasteur" method of microscopic examination, or by any other advanced method and process specified by the Government by notification in the Punjab Gazette from time to time.

(c) He shall abide by such other conditions as may be specified by the Licensing Authority in regard to the working of the grainage.

(d) He shall maintain a record of the results of the rearings from the seed issued from his grainage, frequently inspect the rearings from the seed distributed by him, record the results of such inspections and furnish such information at such time and to such officer of the Sericulture Organisation of Department of Industries, Punjab, as the Licensing Authority may specify about the condition of the crops and yields.

(e) He shall maintain regular accounts and record as specified in Rule 12 and they shall be open for inspection by the officers of the Sericulture Organisation, Punjab. (sic) send to the Sericulture Officer specified by the Licensing Authority in this behalf such returns within such time as the Licensing Authority may by order specify.

(f) He shall give due intimation to the Sericulture Officer specified by the Licensing Authority in this behalf, of the time of each grainage operation and issue the disease-free silkworm seed to the silkworm rearer after they are inspected and passed by the Officer of the Sericulture Organisation authorised by the Licensing Authority.

(g) Whenever the graineur expects a lot of seed cocoons in his grainage, he shall send intimation to the nearest Government Grainage Officer or to such other officer of the Sericulture organisation as the Officer-in-charge of the nearest Government Grainage directs. The dates on which the seed cocoons would be received and the probable date of emergence of the moths from the seed cocoons shall be intimated in advance. Intimation shall also be given as soon as the moths emerge.

(h) The location of any grainage shall not be changed except with the approval of the Licensing Authority or any other officer authorised by it in this behalf.

(i) A list of foreign race seed cocoons rearers employed by the graineur shall be furnished to the Officer of the Sericulture Organisation specified by the Licensing Authority in this behalf.

(j) Only such foreign race seed cocoons as are certified and recommended by the Licensing Authority to suit the locality and the season shall be used by the graineur.

(k) The graineur shall be responsible for any misuse of the foreign race seed cocoons reared by him.

(l)(i) The graineur shall get 5 per cent of moths examined by an officer of the Sericulture Organisation not lower in rank than a Grainage Supervisor and only such layings as are certified by the said officer to the disease-free shall be distributed by the graineur.

(ii) If the graineur is aggrieved by any findings under Sub- Clause (i) he may appeal direct to the Superintendent of Sericulture who shall conduct an independent test of the moth and record his findings which shall be final and binding on the graineur.

(iii) Layings which are not certified as free from disease shall not be distributed and shall be destroyed in the presence of an officer of the Sericulture Organisation.

(m) Every chawki rear shall be bound by the following conditions :-

(i) He shall use only disease-free laying prepared by a licensed graineur and shall produce evidence for having done so on demand by an officer of the Sericulture Organisation not below the rank of Grainage Supervisor.

(ii) He shall maintain a register in Form 'D' which shall be open for inspection by the Officers of the Sericulture Organisation.

No person shall rear silkworms from silkworm seed other than silkworm seed obtained from a licensed graineur, in proof of his having used only silkworm seed obtained from a licensed graineur, the rearer shall preserve the bill issued in respect of the silkworm seed supplied by the graineur and produce it before an officer of the Sericulture Organisation when called upon to do so.
No rearer shall rear silkworms for production of silkworm seed cocoons for the purpose of reproduction unless he holds a license granted by the licensing authority. An application for the license shall be made to the Licensing Authority in Form 'A'. The licensee shall exhibit such license in a prominent place in the place where rearings are carried on.
The following conditions shall be complied with by every person licensed under Rule 6 :-

(a) The silkworm seed rearer must be an experienced rearer knowing all the essential details of silkworm rearing.

(b) Every licensed rearer shall be in possession of mulberry trees, a disinfectable rearing apartment and rearing appliances.

(c) The silkworm seed rearer shall rear pure race silkworm seed obtainable from Government Grainages or any other grainage approved by the Director of Industries, Punjab.

(d) The rearer shall not transfer the worms during the course of rearing from one place to another or from one person to another without the previous permission in writing of Grainage Supervisor.

(e) The rearer shall comply with the written instructions given to him from time to time by the officers of the Sericulture Organisation in the rearing of silkworms and permit them to inspect the rearings and take worms testing at every stage.

(f) The rearer shall allow the officer of the Sericulture Organisation to disinfect the rearing apartments and the appliances, if found necessary, and afford all facilities for disinfection.

(1) The Licensing Authority may withdraw or cancel the license granted under Rules 3 and 6 if it is satisfied that the licensee has failed to conform to the conditions governing the licensee.

(2) An appeal against orders of the Licensing Authority under sub-rule 8(1) shall lie with the Punjab Government in the Industries Department. The decision of the appellate authority shall be final.

Every license shall be renewed before the commencement of each calendar year.
(i) A licence under Section 3 of the Act will be issued free of charge. It shall be valid for one year.

(ii) The fee payable for a duplicate licence shall be Rs. 2.

(iii) The fee realised shall be credited to the head "XXXII - Industries Sericulture."

Appeals under these rules shall be filed with the appellate Authority not later than one month from the date of communication of orders to the party preferring an appeal.
The licensee shall maintain the Accounts and Books in the manner prescribed below :-

(1) A simple cash book for recording all transactions of money.

(2) A register of contingent charges wherein the details of all expenditure are to be shown. All sub-vouchers should be kept in record by the Licensee.

(3) Attendance Register in simple form indicating the names of workers engaged, rate of pay or wages, amount disbursed at the close of the month.

(4) Petty Stock Registers for (i) Consumable, and (ii) Non-consumable stores.

(5) Cocoons Purchase Register in Form E.

(6) Seed Production Register in Form F.

(7) Emergence and Coupling Register of silk-months in Form G.

(8) Register of Microsopic Examination Record in Form H.

(9) Microscopic Examination Book in Form J.
