Bihar Excise (Mahua Flowers) Rules, 2006

Excise and Prohibition Department, Notification, S.O. 439, the 24th January, 2007. - In exercise of the powers conferred by Section 89 of the Bihar Excise Act, 1915, the Government of Bihar, hereby makes the following Rules, namely:-
- Short title, extent and commencement.- (1) These Rules may be called the Bihar Excise (Mahua Flowers) Rules, 2006.
(2) They shall extend to the whole of the State of Bihar, where the Bihar Excise Act, 1915 is in force.
(3) They shall come into force at once.
- Definitions.- In these Rules unless the context otherwise requires:-
(a) "Act" means the Bihar Excise Act, 1915.
(b) "Authorised officer" means an officer of the Excise Department of and above the rank of Sub-Inspector of Excise.
(c) "Form" means a form appended to these Rules.
(d) "Mahua Flowers" means the flowers of Passialatifolla but does not include the berry or seed of the mahua tree.
(e) "Base" means materials recognised and notified as base of country liquor vide Notification No. 470-F dated 15.01.1919.
(f) "Recognised body" means a person or a body of persons or an institution, whether incorporated or not, recognised by the Commissioner of Excise as such for the purpose of these Rules.
(g) "Section" means section of the Bihar Excise Act, 1915.
- Possession of Mahua flowers.- No person other than a person duly authorised by the person holding a licence for the collection of Mahua flowers, one of the bases of country liquor, shall collect or possess more than five kilogram of Mahua flowerswithout a licence granted under these Rules.
- Issue of licence for possession.- A licence for the possession of Mahua flowersexceeding the limit prescribed in Rule 3 of these Rules may be granted to a person requiring Mahua flowers forbona fide industrial, agricultural, scientific, educational or domestic purposes:
Provided that, an owner of Mahua flowers, which are the product of trees belonging to such owner, can keep such Mahua flowers under his own possession for his domestic and agricultural use without obtaining a licence.
- Issue of licence for possession and sale.- (1) A licence for the possession and sale of Mahua flowersexceeding the limit prescribed in Rule 3 of these Rules shall be granted only to:-
(a) A person who has lawfully collected or purchased Mahua flowers for the purpose of sale; or
(b) An owner of Mahua flowers which are the produce of trees belonging to such owner and if such owner intends to utilize Mahua flowers for commercial purpose; or
(c) a recognised body.
(2) Such licence shall be granted only to persons:-
(a) holding a licence for possession or sale of mahua flower; or
(b) holding a permit for the export/import of Mahua flowers.
- Application for grant of licence for possession or sale.- (1) Any person desiring to possess or sell Mahua flowersmay make an application to the Collector or Excise Officer of the district;
(2) an application for a licence to possess Mahua flowers shall contain the following particulars, namely;
(i) the name and complete address of the applicant;
(ii) the particulars of the place or premises where Mahua flowers will be stored or used;
(iii) the quantity of Mahua flowers which will be required for the use per month;
(iv) the period for which the licence is required;
(v) the details of the use or uses to which the Mahua flowers will be put; and
(vi) the purpose for obtaining such licence.
(3) An application to sell Mahua flowers shall contain the following particulars, namely;
(i) the name and address of the applicant;
(ii) the particulars of the place or premises where Mahua flowers will be kept for sale;
(iii) total quantity of Mahua flowers to be stocked for sale during the course of the licence period.
(iv) the period for which the licence is required.
(v) whether the applicant is a trader/owner of mahua trees ora recognised body.
(vi) the detail of the area of clientele in during the likely purpose for which the clients would purchase Mahua flowers.
- Grant of licence.- (1) On receipt of an application under Rule 6, the Collector or the Excise Officer of the district shall make enquiries regarding the particulars given in the application and such other enquiries as he deems necessary. If he is satisfied that the applicant would not misuse the licence and there is no other objection to grant the licence applied for, he may grant the applicant a licence on payment of fees prescribed under sub-rule (2) of this Rule. The licence for the possession of Mahua flowersshall be in Form M.F. (I) of this Rule and the licence for the possession and sale thereof shall be in Form M.F. (II).
(2) The fees in respect of licence granted under sub-rule (1) shall be as specified below:-
(i) For possession-(a) When Mahua flowers are required for bona fide industrial purpose in any factory as defined in the Factories Act and in any other industrial concern-rupees two hundred only;
(b) When Mahua flowers are required for bona fide domestic use, such as use for food or fodder of cattle by a member of a Scheduled Tribe-rupees ten only.
(ii) For sale by a person who has lawfully, collected or purchased the Mahua flowers for the purpose of sale but who is not the owner of the trees of which they are the produce;
(a) When the total quantity allowed for sale during a year does not exceed one hundred quintals, when such quantity is to be stored in a single place of storage in a village or town-rupees two hundred only;
(b) When the total quantity allowed for a sale during a year does not exceed one hundred quintals and when such quantity is to be stored in a town or village-rupees two hundred only for each additional place of storage;
(c) When Mahua flowers are required fa bona fide scientific, agricultural, educational or medicinal purpose-rupees one hundred only. When the total quantity allowed for sale during a year exceeds one hundred quintals per year, and when such quantity is to be stored in a single place of storage in a village or town-rupees five hundred only and when such quantity is to be stored in more than one place of storage in a town-rupees five hundred only for each additional place of storage.
(iii) For the sale of Mahua flowers by the owner of trees of which the Mahua flowers are the produce;
(a) When the total quantity allowed for sale during a year does not exceed fifty quintals and when such quantity is to be stored in one village or town (whether in one place or more than one place)-rupees fifty only;
(b) When the total quantity allowed for sale during a year exceeds fifty quintals but does not exceed one hundred quintals and when such quantity is to be stored in a store in a single place of storage in a village or town-rupees one hundred only;
(c) one hundred quintals and when such quantity is to be stored in a single place of storage in a village or town-rupees five hundred only and when such quantity is to be stored in more than one place of storage in a village or town-rupees two hundred only for each additional place of storage.
(iv) The fee in respect of a licence for the sale of Mahua flowers granted to a recognised body shall be rupees one hundred only.
- Limits of Possession by the Licence Holder.- Before granting any licence under Rule-7 the Collector or Excise Officer of a district shall, after making such enquiries as he deems fit, fix the maximum quantity of Mahua flowerswhich the licence holder may possess;
(a) During the period of the licence or at any one time; and
(b) In the case of a licence granted for the possession of Mahua flowers for bona fide use other than use in distillation, during any one month.
- Period of Licence.- No licence under these Rules shall be granted for a period beyond the 31st of March next following the date of commencement of the licence.
- Permit for collection.- No permit for the collection of the Mahua flowersshall be
(a) the Mahua flowers are the produce of trees belonging to him; or
(b) such person is lawfully entitled to the ownership of Mahua flowers of trees not belonging to him.
- Application for permit to collect Mahua flowers.- Any person desiring to collect Mahua flowersshall make an application to the Collector or Excise Officer of the district where the Mahua flowers trees are situated for a permit to collect such Mahua flowers. The application shall contain the following particulars, namely;
(a) the name and address of the applicant;
(b) the situation of the trees from which Mahua flowers shall be collected,
(c) the number of trees;
(d) the name and address of the owner of the trees;
(e) name of the place to which the Mahua flowers will be transported after collection;
(f) whether the applicant has got any licence for the possession or sale of Mahua flowers at the above place; if so, its number and date;
(g) the period for which the permit is required to be valid.
- Grant of permit to collect.- (1) On receipt of an application under Rule 11, the Collector or Excise Officer of the district may make enquiries regarding the particulars given in the application and also such other enquiries as he deems necessary. If the Collector or Excise Officer is satisfied that there is no objection to grant the permit applied for, he may grant a permit in Form M.F. (III) on payment of a fee of rupees twenty only.
(2) The permit shall contain four parts which shall be dealt-with as under;
Part I - shall be retained for the record of the officer issuing the permit;
Part II - shall be given to the applicant;
Part III - shall be sent to the Authorized Officer of the place where mauha flowers are to be transported after collection.
Part IV - shall be sent to the vendor from whom the Mahua flowers are to be purchased.
- Condition of Granting Permit.- No permit for the purchase or transport of Mahua flowersshall be granted to any person unless such person holds a licence for the possession or sale of Mahua flowers.
- Application for permit to purchase.- Any person desiring to purchase Mahua flowersshall make an application to the Collector or Excise Officer for a permit to purchase such flowers. The application shall contain the following particulars, namely;
(i) the name and address of the applicant;
(ii) whether the applicant holds a licence for the possession or sale of Mahua flowers and its number and the place in respect of which such licence is held;
(iii) the quantity of Mahua flowers to be purchased;
(iv) the name and address of the person by whom Mahua flowers are to be purchased;
(iv) the place to which Mahua flowers will be transported after purchase;
(v) the route by which Mahua flowers will be transported; and
(vi) the period for which the permit is required to be valid.
(vii) purpose for which it is purchased.
- Grant of permit to purchase.- (1) On receipt of an application under Rule 14, the Officer concerned shall make enquiries regarding the particulars given in the application and also such other enquiries as he deems necessary. If the concerned Officer, is satisfied that there is no objection to grant the permit applied for, he may grant such permit in Form M.F. (IV) on payment of a fee, in the case of a member of a Scheduled Tribe of rupees five only and in any other case of rupees twenty only.
(2) The permit shall contain four parts which shall be dealt with as under;
Part I - shall be retained on the record of the Officer issuing the permit;
Part II - shall be given to the applicant;
Part III - shall be sent to the Officer of the place where Mahua flowers are to be transported after purchase; and
Part IV - shall be sent to the vendor from whom the Mahua flowers are to be purchased.
- Application for transport permit.- Any person desiring to transport Mahua flowersshall make an application to the Collector or Excise Officer of the district for a permit to transport Mahua flowers. The application shall contain the following particulars namely.
(a) the name and address of the applicant;
(b) the number of the licence for possession or sale, as the case may be, of Mahua flowers held by the applicant;
(c) the quantity of Mahua flowers to be transported;
(d) the place from and to which the Mahua flowers are to be transported;
(e) the route by which the Mahua flowers will be transported;
(f) the name and address of the person from whose premises Mahua flowers will be removed;
(g) the number of licence held by the vendor;
(h) the period for which the permit is required to be valid.
- Grant of Transport permit.- (1) On receipt of an application under Rule 16, the Collector or Excise Officer of the district shall make enquiries regarding the particulars given in the application and also such other enquiries as he deems necessary. If the concerned Officer is satisfied that there is no objection to grant the permit applied for, he may grant such permit in Form M.F. (V) on payment of a fee, in the case of a member of a Scheduled Tribe, of rupees, five only and in any other case of rupees twenty only.
(2) The permit shall contain four parts which shall be dealt with as under;
Part I - shall be retained on the record of the Officer issuing the permit;
Part II - shall be sent to the person supplying the Mahua flowers;
Part III - shall be sent to the Authorized Officer in whose jurisdiction the place of business of the permit holder is situated; and
Part IV - shall accompany the consignment of Mahua flowers and thereafter shall be kept by the permit holder.
- Import permits.- No permit for the import of Mahua flowersshall be granted to any person unless such person holds a licence for the possession or sale of Mahua flowers:
Provided that such permit may be granted to other persons in case the quantity to be imported does not exceed the prescribed limit in weight, under Rule 3 and Mahua flowers are to be used tor bona fide scientific, agricultural, educational, medicinal or domestic purpose.
- Application for Import Permit.- Any person desiring to import Mahua flowersshall make an application to the Collector or Excise Officer for a permit. The application shall contain the following particulars namely.
(a) the name and address of the importer;
(b) the name of the licensee, for the possession or sale as the case may be, of Mahua flowersheld by the applicant;
(c) the quantity of Mahua flowers authorised for possession under the licence or without a licence, as the case may be;
(d) the quantity of Mahua flowers to be imported;
(e) the place from and to which the Mahua flowers are to be imported;
(f) the route from and to which the Mahua flowers will be imported;
(g) the name and address of the person by whom the Mahua flowers are to be imported;
(h) the purpose or purposes for which the Mahua flowers are to be imported; and
(i) the period for which the permit is required to be valid.
- Grant of Import Permit.- (1) On receipt of an application under Rule 19, the Collector or Excise Officer may make enquiries regarding the particulars given in the application and also such other enquiries as he deems necessary. If the concerned Officer is satisfied that there is no objection to grant the permit applied for he may grant such permit in Form M.F. (VI) on payment of a fee of rupees two only.
(2) The permit shall contain four parts which shall be dealt with as under;
Part I - shall be retained on the record of the Officer issuing the permit;
Part II - shall be sent to the person from whom the Mahua flowers are to be imported;
Part III - shall be sent to the Excise Commissioner of the place from which Mahua flowers are to be imported; and
Part IV - shall be sent to be handed over to applicant and it shall accompany the consignment under import and there after be kept with the applicant.
- Export Permit.- No permit for the export of Mahua flowersshall be granted to any person unless such person holds a licence for the possession or sale of Mahua flowers on a permit for buying Mahua flowers:
Provided that such permit may be granted to other person in case the quantity to be exported does not exceed the limit in weight prescribed in Rule 3.
- Application for Export Permit.- Any person desiring to export Mahua flowersshall make an application to the concerned Officer for a permit. The application shall be accompanied by an import authorization or a no objection certificate issued by an officer duly authorized in this behalf of the place to which Mahua flowers are to be exported and shall contain the following particulars, namely:
(a) the name and address of the exporter;
(b) the number of the licence for the possession or sale of Mahua flowers held by the applicant or the number of permit for buying Mahua flowers, if any, held by him;
(c) the quantity of Mahua flowers to be exported;
(d) the place from and to which Mahua flowers are to be exported;
(e) the route by which the Mahua flowers will be exported;
(f) the name and address of the person to whom the Mahua flowers are to be exported;
(g) the period for which the permit is required to be valid; and
(h) the number and the date of import authorisation or no objection certificate granted by the Excise Authority of the place to which Mahua flowers are to be exported.
- Grant of Export Permit.- (1) On receipt of an application under Rule 22, the Collector or Excise Officer of the district may make enquiries for the verification of the particulars given in the application and also such other enquiries as he deems necessary. If the concerned officer is satisfied that there is no objection to grant the permit applied for he may grant such permit in Form M.F. (VII) on payment of a fee of rupees two only.
(2) The permit shall contain four parts which shall be dealt with as under;
Part I - shall be retained on the record of the Officer issuing the permit;
Part II - shall be sent to the persons supplying the Mahua flowers;
Part III - shall be sent to the officer or the place to which Mahua flowers are to be exported, and who has issued the import authorization or no objection certificate; and
Part IV - shall accompany the consignment of the Mahua flowers and thereafter it may be kept by the person to whom the Mahua flowers are sent.

Licence for the Possession of Mahua flowers
Licence is hereby granted to (hereinafter called as the Licensee) on payment in advance of a fee of Rs authorizing him to possess Mahua flowers under and subject to the provision of the Bihar Excise Act, 1915 and the Rules, Regulations and Orders made thereunder at (hereinafter called to as "The licensed premises" during the period commencing from...........to both days inclusive) subject to the following conditions, namely:-
Conditions
- The licensee shall not have in his possession more than kilograms of Mahua flowersat any one time. He shall not obtain or use more than kilograms during any year/month.
- The licensee shall not store or keep Mahua flowersin any place other than the licensed premises.
- (a) The licensee shall not use the Mahua flowersfor any purpose other than that specified below-(here specify purpose or purposes).
(b) The licensee shall not sell any Mahua flowers to any person.
- The licensee shall not possess or use under this licence any Mahua flowersother than Mahua flowerswhich are collected, purchased or imported by him under the Rules.
- The licensee shall maintain from day-to-day true and correct accounts in a book paged and stamped with the seal of the Collector or Excise Officer of the district.
- The licensee shall furnish to the District Excise Officer of the place in which the licensed premises are situated, not later than the 5th day of each month an extract of the account maintained by him and relating to the previous month.
- The licensed premises including all receptacles within the licensed premises and the accounts maintained by the licensee be open, at all reasonable times for inspection by the Excise Commissioner, Collector or any other Officer duly authorized in that behalf.
- The licensee shall keep his premises and other receptacles used for storage of Mahua flowersin clean and in good condition.
- Except with the permission of the Collector or the Excise Officer of the district the licensee shall not sell, transfer or sublet the right conferred upon any agreement or arrangement, which in the opinion of the concerned officer is of the nature of a sub-lease. If any dispute arises whether any agreement or arrangement is in the nature of a sub-lease, the decision of the above said Officer in the matter shall be final and binding on the licensee.
- No person shall be recognized as the partner of the licensee for purpose of his licence unless the partnership is disclosed to the Collector or Excise Officer of the district before the licence is granted and the names of the partners has been entered jointly in the licence or if the partnership has been entered into after the granting of this licence, unless the aforesaid officer agrees on application made to him to alter the licence and to add, the name or the names of the partners in the said licence.
- The licensee shall maintain in the licensed premises an inspection book paged and stamped with the seal of the Collector or Excise Officer of the district. The licensee shall on the termination of the licence deliver up the inspection book the accounts and the licence to the Excise Officer in whose jurisdiction the licensed premises are situated.
- The licensee shall comply with all Rules, orders and directions which may be made or issued by the State Government or any competent officer under the Act.
- The licensee, his heirs, legal representatives or assignee shall have no claim whatsoever to the continuance or renewal of this licence after the expiry of the period for which it is granted. It shall be entirely within the discretion of the Collector or Excise Officer of the district to permit or not, the assignee of the holder of the licence in case of sale or transfer, or the heir or legal representative of the holder of the licence in case of death, or have the benefit of the licence for the unexpired portion of the term for which it is granted.
- This licence may be suspended or cancelled by the Licensing Authority in accordance with the provision of the Bihar Excise (Mahua flowers) Rules, 2006 and that of the Bihar Excise Act, 1915.

Licence for the Possession of Mahua flowers
Licence is hereby granted to...........(hereinafter called as the Licensee) on payment in advance of a fee of Rs authorizing him to possess Mahua flowers under and subject to the provision of the Bihar Excise Act, 1915 and the Rules regulations and orders made thereunder at (hereinafter called to as "The licensed premises" during the period commencing from to both days inclusive) subject to the following conditions, namely-
Conditions
- The total quantity of Mahua flowerssold by the licensee during the currency of the licence period together with the unsold balance of Mahua flowersshall not exceed Kilos.
- The licensee shall not store or keep Mahua flowersin any place other than the licensed premises.
- The licensee shall not use the Mahua flowersfor any purpose other than sale.
- The licensee shall not, possess for sell under this licence any Mahua flowersother than those which are collected, purchased or imported by him.
- The licensee shall not, without permission from the Collector or Excise Officer of the district sellMahua flowersto any person except-
(a) in the State of Bihar, to a person holding a valid licence for possession or sale of Mahua flowers under the Bihar Excise (Mahua flowers) Rules, 2006 and a permit for purchase or transport of the same under the said rules; and
(b) outside the State of Bihar, to a person holding an import authorization or a no-objection certificate from a duly authorized officer of the place to which Mahua flowers are to be sent and valid permits for the purchase and export thereof under the rules.
- The licensee shall not, except with the permission of the Collector or Excise Officer of the district effect any sales of Mahua flowersbefore 6 A.M. or after 6 P.M. (Indian Standard Time).
- The licensee shall maintain from day-to-day a true and correct account in book, paged and stamped with the seal of the Collector or Excise Officer of the district.
- The licensee shall furnish the Excise Officer of the place in which the licensed premises are situated not later than the fifth day of each month an extract of the accounts maintained by him and relating to the previous month.
- The licensed premises including all receptacles within the licensed premises, the accounts maintained by the licensee under this licence, be open at all reasonable times to inspection by the Collector or any Officer duly authorized in that behalf.
- Except with the permission of the Collector or Excise Officer of the district the licensee shall not sell, transfer or sublet the right conferred upon him by this licence nor shall he, in connection with the said right, enter into any agreement or arrangement which, in the opinion of the Collector or Excise Officer of the district of the nature of a sub-lease. If any dispute arises whether any agreement or arrangement is in the nature of a sub-lease the decision of the Collector in the matter shall be final and binding on the licensee.
- No person shall be recognised as the partner of the licensee for the purpose of this licence unless the partnership is disclosed to the Collector or Excise Officer of the district before the licence is granted and the names of the partner has been entered jointly in the licence or if partnership has been entered into after the granting of this licence, unless the Collector or Excise Officer of the district agrees on application made to him to alter the licence and to add the name or names of the partner or partners in the said licence.
- The licensee shall maintain in the licensed premises an inspection book page stamped with the seal of the Collector or Excise Officer of the district in which inspecting officers may record their remarks while inspecting the licensed premises. The licensee shall on the termination of the period of the licence deliver up the inspection book, the accounts and the licence to the Excise Officer in whose jurisdiction the licensed premises are situated.
- The licensee shall comply with all the Rules, orders and directions which may be made or issued by the State Government or any Authorized Officer.
- The licensee shall exhibit at a conspicuous place in the licensed premises a sign board bearing the following inscription in legible English and in Devanagiri.

- The licensee shall carry on the business of his shop either personally or by an agent or servant duly authorized by him countersigned by an Excise Officer duly authorized in that behalf by the Collector.
- The licensee, his heirs, legal representatives or assign shall have no claim whosoever to the continuance or renewal of this licence after the expiry of the period for which it is granted. It shall be entirely within the discretion of the Collector or Excise Officer of the district to permit or not, the assignee of the holder of the licence in case of sale or transfer, or the heir or legal representative of the holder of the licence in case of death to have the benefit of the licence for the unexpired portion of the term for which it is granted.
- This licence may be suspended or cancelled or withdrawn by the Collector or Excise Officer of the district in accordance with the provisions of Section 42 of the Bihar Excise Act, 1915.
