Notification No. BERC/Regulation-2/2006. - In exercise of powers conferred on it by sub-section (1) of Section 127 read with Clause (zo) of sub-section (2) of Section 181 and all powers enabling it in that behalf of the Electricity Act, 2003, the Bihar Electricity Regulatory Commission hereby makes the following Regulations providing for procedure for preferring an appeal before the Appellate Authority:
- Short Title, Extent and Commencement.- (1) These Regulations may be called the Bihar Electricity Regulatory Commission (Procedure for preferring appeal before the Appellate Authority) Regulations, 2006.
(2) These Regulations shall extend to the whole of the State of Bihar.
(3) These Regulations shall come into force on the date of its publication in the Official Gazette.
- Definitions.- (1) In these regulations, unless the context otherwise requires:-
(a) "Act" means the Electricity Act, 2003 (36 of 2003);
(b) "Appellate Authority" means the authority prescribed under sub-section (1) of Section 127 read with clause (u) of sub-section (2) of Section 176 of the Act;
(c) "Assessing Officer" means the assessing officer appointed under Section 126 of the Act.
(d) "Commission" means the Bihar Electricity Regulatory Commission;
(e) "Licensee" means a Distribution Licensee authorised to operate and maintain a distribution system and supply electricity to consumers in the concerned area of supply and shall include the deemed licensee under the provisions of Section 42 of the Act.
(2) Words and expressions used but not specifically defined in these Regulations but defined in the Act shall have the meanings assigned to them in the Act.
- Preferring an Appeal.- (1) A person aggrieved by a final order of an assessing officer made under Section 126 of the Act, may, within thirty (30) days of the said order, prefer an appeal before the Appellate Authority.
(2) The appeal shall be made in the form specified in the Schedule.
(3) The memorandum of appeal shall be signed and verified in the manner specified in the Schedule on a non-judicial stamp paper of Rupees five only.
(4) The memorandum of appeal shall be accompanied with the fee as specified by the Commission in the Bihar Electricity Regulatory Commission (Fees, Fines & Charges) Regulations, 2005.
(5) The fee shall be paid in such form as the Appellate Authority may specify.
(6) The appellant shall deposit an amount equal to one-third of the assessed amount with the licensee in cash or by way of bank draft. Documentary proof of such deposit shall be enclosed alongwith the memorandum of appeal.
- Disposal of Appeal.- (1) The Appellate Authority after hearing the parties shall as far as may be practicable pass appropriate order within a period of 120 days from the date of preferring appeal by the appellant.
(2) The Appellant Authority shall send copy of the order to the assessing officer and the appellant.
- Reporting to the Commission.- Distribution licensee shall furnish to the Commission with one month from the end of the quarter, the status of disposal of the appeals by the Appellant Authority giving the following details:
(a) Number of appeals pending at the beginning of the quarter.
(b) Number of new appeals preferred during the quarter.
(c) Number of appeals disposed of during the quarter.
(d) Number of pending appeals at the end of the quarter.
- Less than six months
- More than six months but less than a year
- Over one year
- Miscellaneous.- (1) Subject to the provisions of the Electricity Act, 2003 and these Regulations, the Commission may, from time to time, issue orders and practice directions in regard to the implementation of these Regulations and procedures to be followed.
(2) The Commission may, at any time, add, vary, alter, modify or amend any of the provisions of these Regulations.
(3) If any difficulty arises in giving effect to any of the provisions of these Regulations, the Commission may, by general or special order, do any thing not being inconsistent with the provisions of the Act, which appears to be necessary or expedient for the purpose of removing the difficulties.
