Arunachal Pradesh Agricultural and Horticultural Service Rules, 1992

Notification No. AGRI/E-97. - In exercise of powers conferred by the proviso to Article 309 of the Constitution, the Governor of Arunachal Pradesh hereby makes the following rules, namely:-

  1. Short title and commencement.- (i) These rules may be called Arunachal Pradesh Agricultural and Horticultural Service Rules, 1992.

(ii) They shall come into force on the date of their publication in the official gazette.

  1. Definitions.- In these rules unless the context otherwise requires :

(a) "Appointing Authority" means the Governor of Arunachal Pradesh or such other authority as may be notified by the Governor.

(b) "Commission" means the Arunachal Pradesh Public Service Commission.

(c) "Committee" means the Departmental Promotion Committee as specified under Rule 12 of these rules.

(d) "Government" means the Government of Arunachal Pradesh.

(e) "Governor" means the Governor of Arunachal Pradesh.

(f) "Member of the Service" means a person appointed under these rules to any post in the service.

(g) "Service" means the Arunachal Pradesh agricultural and Horticultural Service constituted under these rules.

(h) "Schedule" means the Schedule appended to these rules, and

(i) "year" means a calendar year.

  1. Constitution of the Service.- These shall be constituted service to be known as Arunachal Pradesh Agricultural and Horticultural Service consisting of persons appointed to the service in accordance with the provisions of these rules, provided that the Governor may, at the commencement of these rules, appoint to the Service any person who at such commencement holds any of the posts specified in Schedule 1,
  2. Composition of Service.- (i) The Service shall consist of such categories of posts as the Governor may determine from time to time.

(ii) At the Government of these rules, the service shall consist of the following categories of posts, viz.-

(a) Selection Group : (i) Directors
(b) Group 'A' (ii) Jt. Directors
(iii) Dy. Directors/Agronomists/ Horticulturists.
(iv) Dist. Agricultural Officers/ District Horticultural Officers/ Project Officers (MCP)/ District Training Officer/ Farm Manager (Sonajuli)/ District Horticulturists/Seed Testing Officer/ Vegetable, Seed Production Officer/ Principal GTC.
(c) Group 'B' (i) Sub Divisional Agricultural Officer
(ii) Peripatetic Training Officer
(iii) Instructor GTC, Pasighat
(iv) Plant Protection Officer
(v) Subject Matter Specialist
(vi) Entomologist
(vii) Entomologist and Nematologist
(viii) Plant Pathologist
(ix) Research Officer
(x) Senior Technical Assistant
(xi) Junior Micologist
(xii) Assistant Soil Chemist
(xiii) Spices Development Officer
(xiv) Junior Seed Analyst
(xv) Sub-Divisional Agricultural Officer (Vegetable).
(xvi) Extension Officer Agriculture.
(xvii) Extension Officer Horticulture.
(xviii) Extension Officer Plant Protection.

(iii) Each of the above categories of posts mentioned in Sub-rule (2) shall form an independent cadre. Members of any category shall have no right to claim for appointment to the higher category except in accordance with the provisions or these rules.

  1. Strength of the Service.- (i) The strength of the service and the posts shall be as the Governor may, from time to time, determine.

(ii) At the commencement of these rules, the strength of the service shall be as shown in Schedule I.

  1. Appointment to the post of Directors.- Appointment to the post of Director of Agriculture and Director of Horticulture shall be made by promotion from the select list prepared under Rule 13 from amongst the Joint Directors who have rendered not less than five years of service as Joint Director.
  2. Appointment for the post of Joint Directors.- Appointment to the post of Joint Director shall be made by promotion from the select list prepared under Rule 13 from amongst the Deputy Directors/Agronomist/Horticulturist with not less than three years service as Deputy Director of Agriculture, Horticulture, Agronomist and Horticulturist.
  3. Appointment to the post of Deputy Directors/Agronomist/ Horticulturist.- Appointment to the above posts shall be made by promotion from the select list prepared under Rule 13 from amongst the persons who have rendered not less than two years of service in the following posts, namely:-

(i) District Agricultural Officer.

(ii) District Horticulture Officer.

(iii) District Training Officer.

(iv) Project Officer (M.C.P.).

(v) Farm Manager, Government Seed Farm Sonajuli

(vi) Seed Testing Officer.

(vii) Vegetable Seed Production Officer.

(viii) Principal G.T.C. Pasighat.

(ix) District Horticulturist.

  1. Appointment to the following posts:

(i) District Agriculture Officer.

(ii) District Horticulture Officer

(iii) District Training Officer.

(iv) Project Officer (M.C.P.).

(v) Farm Manager, Government Seed Farm, Senjuli.

(vi) Seed Testing Officer.

(vii) Vegetable Seed Production Officer.

(viii) Principal G.T.C. Pasighat.

(ix) District Horticulturist.

Appointment to the above posts shall be made by promotion from the select list prepared under Rule 13 from amongst the persons who have rendered not less than three years service in the following posts namely:-

(i) Sub-divisional Agricultural Officer.

(ii) Peripatetic Training Officer.

(iii) Instructors G.T.C. Pasighat.

(iv) Plant Protection Officer.

(v) Subject Matter Specialist.

(vi) Entomologist.

(vii) Plant Pathologist.

(viii) Research Officer.

(ix) Senior Technical Assistant.

(x) Junior Mycologist.

(xi) Asstt. Soil Chemist.

(xii) Specis Development Officer.

(xiii) Junior Seed Analyst.

(xiv) Sub-Divisional Agricultural Officer (Vegetable).

(xv) Entomologist-cum-Nematologist.

  1. Appointment to the following posts :

(i) Sub-Divisional Agricultural Officer

(ii) Sub-Divisional Agricultural Officer (Vegetable)

(iii) Peripetatic Training Officer

(iv) Instructor, G.T.C. Pasighat.

(v) Plant Pathologist

(vi) Senior Technical Assistant

(vii) Assistant Soil Chemist .

(viii) Research Officer

(ix) Subject Matter Specialist

(x) Entomologist-cum-Namatologist

(xi) Junior Seed Analyst

(xii) Entomologist

(xiii) Species Development Officer

(xiv) Junior Mycologist

(xv) Plant Protection Officer.

Appointment to the above posts shall be made from select list prepared under Rule 13 from Amongst the Extension Officers who have rendered not less than three years of service as Extension Officer.

  1. Appointment to the post of Extension Officer.- (i) Appointment to the post of Extension Officers shall be made by direct recruitment on the basis of a competitive examination comprising of written examination and viva-voice/personality test to be conducted by the Arunachal Pradesh Public Service Commission.

(ii) The competitive examination shall be held on such intervals as the Governor may, in consultation with the Commission, from time to time determine, and to deal and place for such examination shall be fixed by the Commission.

(iii) The written examination shall be conducted by the Commission in accordance with such rules and syllabus as may be prescribed by the Governor in consultation with the Commission.

(iv) In the vacancy to be filled upon the result of competitive examination, there shall be reservation in favour of scheduled Castes and Scheduled Tribes to the extent and subject to the conditions as the Government may, from time to time prescribe.

(v) The Commission shall prepare a list of candidates who qualify in the competitive examination, by such standard as may be prescribed or as may be decided by the Commission, in order of merit.

(vi) Inclusion of a candidate's name in the merit list shall confer no right to the appointment unless the Appointing Authority is satisfied, after such enquiry as may be considered necessary, that the candidate is suitable in all respects for appointment to the service.

  1. Departmental promotion Committee.- (i) For the purpose of making appointment by promotion to the post of Directors under Rule 6, there shall be a departmental promotion committee consisting of the following Members, namely,
1. Chairman or a Member of the Commission Chairman
2. Secretary of the concerned Department Member
3. One tribal officer not below the rank of Secretary to the Government of Arunachal Pradesh Member
4. Secretary of the Department not connected with the work of the Department. Member

(ii) For the purpose of appointment by promotion under Rules 7, 8, 9 and 10, there shall be a Departmental Promotion Committee consisting of the following Members:-

1. Chairman or a Member of the Commission Chairman
2. Secretary of the concerned Department Member
3. One tribal officer not below the rank of Secretary to the Government of Arunachal Pradesh Member
4. Secretary of the Department not connected with the work of the Department. Member
  1. Considering and recommendation by the Commission for appointment by promotion.- (i) As soon as a case for promotion to any post in the service arises, the Appointing Authority shall send to the Commission all relevant records of eligible officers and such other available information as may be required by the Commission to enable it to consider candidates fit for promotion.

(ii) After consideration of the merit and seniority of candidates within the promotion zone, the Commission shall make its recommendation in respect of such persons considered fit for promotion and place their names in order of preference in a panel of the respective merit list. The merit list or panel shall be forwarded by the Commission to the Appointing Authority.

  1. Period of validity of select list.- The merit list or panel shall ordinarily be in force for a period of one year unless it is reviewed or revised earlier, provided that in the event of any lapse in the conduct or performance of duties on the part of any person in the merit list or panel, the Appointing Authority may, if he thinks fit, omit or remove the name of any such person from the merit list in consultation with the Commission. The reasons for such omission/removal shall be recorded in writing.
  2. Eligibility for appearing at the competitive examination.- (i) In order to be eligible to compete at the examination a candidate must satisfy the following conditions, namely:

(a) he must be a citizen, of India.

(b) he must have attained the age of 21 years and must not have exceeded the age of 28 years on the first day of the year in which the advertisement for the post is notified, provided that nothing in these rules shall affect reservation and other concessions required to be provided for Scheduled Castes and Scheduled Tribes and other categories of persons in accordance with the orders issued by the Government from time to time in this regard.

(c) he must hold a Bachelors Degree in Agricultural/Horticultural Science from any University recognised in India.

(d) he must pay the fees prescribed by the Commission.

(ii) The decision of the commission as to the eligibility or otherwise of candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Commission shall be limited to the examination.

  1. Appointment to the Service.- (i) Appointment to the service shall be made by the Appointing Authority and shall be notified in the official Gazette.

(ii) A person shall join within thirty days from the date of receipt of the order of Appointment, failing which, and unless the Governor extends the period which shall not in all exceed three months, the appointment shall stand cancelled.

(iii) For appointment to the service, a person shall also satisfy the following conditions, namely he-

(a) should be of good character;

(b) should be of sound health and free from any bodily defect of infirmity which may render him unfit in discharging efficiently his duties in the service;

(c) should not have been convicted for any offence involving moral turpitude; and

(d) should not have more than one spouse living unless exempted by Government on special grounds.

(iv) No person who attempts to enlist support for his candidature either directly or indirectly by any recommendation whether written or oral, shall be appointed to the service.

Seniority. - (1) The inter-se-seniority of members service who immediately before the commencement of these rules are holding, any of the posts shown in the schedule, shall be according to the date of their appointment to the post in the respective cadre before the commencement of these rules.

(2) The inter-se-seniority of members appointed to the service after the commencement of these rules shall be in the order in which their names appear in the merit list or panel mentioned in Rule 13 or as the case may be, the merit list mentioned in Rule 11 such members shall be junior to all members mentioned n sub-rule (1) in the respective cadre.

  1. Probation and confirmation.- (i) A person appointed to any post in the service after the commencement of these rules, other than members of the services appointed by promotion, shall be placed on probation for a period of two years from the date of appointment to such post. The pay of a probationer shall be fixed in accordance with the provision of the Fundamental Rules and subsidiary Rules as applicable to the employees of this Government.

Provided that the Governor may in suitable case extend the period of probation by a further period not exceeding one year.

(ii) Unless the Appointing Authority otherwise decides and subject to availability of the permanent posts, a probationer shall by order of the Authority be confirmed in the service on satisfactory completion of the period of probation and on passing such departmental exams/tests as may be or as and when prescribed by the Governor of Appointing Authority.

(iii) A probationer shall be liable to be discharged from the service, or as the case may be reverted to his substantive post, if any, if his performance is found not satisfactory or if he fails in the prescribed departmental exam/test or if he is otherwise considered unsuitable during or at the end of period of probation, or if on any information received relating to his nationality, age, health, character and antecedents, the Appointing Authority is satisfied that the probationer is ineligible or otherwise unfit for being a member of the service.

(iv) A person who immediately before the commencement of these rules is holding any post in the schedule and has been confirmed in any of the posts therein shall be deemed to have been confirmed in the service in that post under these rules.

  1. Pay Scale.- The scale of pay admissible to the members of the service in different posts.are shown in column 5 of the Schedule subject to revision by he Government from time to time.
  2. Leave, Pension and other conditions of service.- All matters generally relating to pay and allowance, leave, pension, discipline and other conditions of service shall regulated by rules and order as are from time to time applicable to other officers of corresponding grade/status of the Government.
  3. Power of Governor to dispense with or relax any rules.- For the purpose of removing any difficulty in the implementation of these rules or where the Governor is satisfied that the operation of any of these rules may cause undue hardship in any particular case, the Governor may dispense with or relax any of these rules to such extent and subject to such conditions as he may consider necessary for resolving the difficulty or for dealing with the case in a just and suitable manner.

Provided that the case of any person shall not be dealt with any manner less favourable to him than that provided by any of these rules.

  1. Interpretation of the Rules.- If any question arises relating to the interpretation of any of these rules, it shall be referred to the Government whose decision thereon shall be final.
  2. Repeal and saving.- All rules, orders or notifications corresponding to and in force immediately before the Commencement of these rules are hereby repealed.

Provided that all orders made or action taken under the rules, orders or notifications so repealed or any action taken in pursuant thereto shall be deemed to have been validly made or taken under the corresponding provisions of these rules.
