- Short title, extent and commencement.- (1) These rules may be called the Nagaland Coffee Estates Owners Registration Rules, 1984.
(2) They shall extend to the whole of the State of Nagaland.
(3) The shall come into force from the date of their publication in the Nagaland Gazette.
- Definitions.- In these rules-
(i) 'Act' means the Coffee Act, 1942 (Central Act 7 of 1942);
(ii) 'Board' means Coffee Board constituted under Section 4 of the Act;
(iii) 'Government' means the Government of Nagaland ;
(iv) 'Form' means a form appended to these rules ;
(v) 'Registering Officer' means the Registering Officer appointed by the Government under sub-section (1) of Section 14 of the Act within whose jurisdiction the whole or any part of estate is situated ;
(vi) all other words and expressions used herein and not defined but defined in the Act shall have the meanings assigned to them in the Act.
- Registration of coffee estate.- An application for registration under Section 14 of the Act shall be made to the Registering Officer in duplicate in Form 'A' and shall be accompanied by a fee of rupees five in respect of each coffee estate owned by the applicant.
- Issue of registration certificate.- If the applicant is registered as an owner in respect of the Coffee Estate as applied by him, the registering officer shall issue to the said applicant a certificate of registration in Form 'B'.
- Intimation of transfer of coffee estates by registered owner and cancellation of registration certificate.- [(1) Subject to the Nagaland Land and Revenue Regulation (Amendment) Act (Act No. 8 of 1978) a registered owner of coffee estate shall if he sells or otherwise transfers any of his estates, the Registering Officer shall cancel the said registration and issue necessary certificate of cancellation of registration in Form 'D'. Intimation to the registering officer within one month of such sale or or transfer, particulars of the estate sold or transferred and the name and postal address of the person to whom he has sold or transferred it and shall at the same time make an application in Form 'C' for cancellation of the registration of his ownership in respect thereof.
(2) On receipt of an application in Form 'C' under sub-rule (1) for cancellation of registration in respect of a coffee estate from the registered owner of such estate on the ground that he has ceased to be the owner thereof.]
(3) Where an application for cancellation of registration in respect of a coffee estate is not received within the prescribed time but an application in Form 'A' in respect of the same estate made by a person other than the registered owner thereof is received by the registering officer and is pending before him, the registering officer shall after giving the registered owner the intimation in respect of the said coffee estate, after recovering a fee of Rs. 5 from the registered owner together with a penalty of Rs. 5 thereof, may thereafter register the same in the name of the new applicant.
- Procedure for issue of certificate or cancellation of registered certificate.- To certificate of cancellation of registration in respect of any coffee estate or estates shall be issued by the registering officer without giving any advance notice of not less than one month to the Board of his intention to do so.
- Maintenance of records by the registering officer.- The registering officer shall maintain a register of registered owners in Form 'E' and of registered estates in Form 'F' and shall forward to the Board from time to time certified copies of all entries in those registers and copy of every certificate of cancellation in Form 'D' which has been issued by him. He shall also forward to the Board a duplicate copy of every application in Form 'A' when the application is complied with.
- The Government may, if considers it necessary to secure compliance with the provisions of these rules, depute an official to inspect any estate and the record maintained by any registered owner of coffee estates.
