Mizoram, Agriculture Department (Group A) Post Recruitment Rules, 1993

No. A. 12018/73/80-APT(B), the 21st June, 1993. - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Mizoram is pleased, to make the following rules relating to the recruitment to the post of sub-Divisional Agriculture Engineer Mechanic (Group A) in the Department of Agriculture, Government of Mizoram, namely :

  1. Short title and commencement.- (i) These rules may be called the Mizoram Agriculture Department (Group A) post Recruitment Rules, 1993.

(ii) They shall come into force on the date of their publication in the Official Gazette.

  1. Application.- The Rules shall apply to the post specified in Col. 1 of the Annexure-1 hereto annexed.
  2. Number of posts, classification and scale of pay.- The number of the said posts their classification and the scale of pay attached thereto shall be as specified in col. 2 to 4 of the Annexure-1 aforesaid.
  3. Method of recruitment age limit and other qualification.- The age limit, qualifications and other matters relating to the said post, shall be as specified in columns 5 to 14 of the Annexure-1.

Provided that the upper age limit prescribed for direct recruitment may be relaxed in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government or Government or Mizoram from time to time.

  1. Disqualification.- No person,

(a) Who has entered into or contracted a Marriage with a person having a spouse living; or

(b) Who having a spouse living has entered into or contracted marriage with any person shall be eligible for appointment to the said post.

Provided that the Governor may if satisfied that such marriage is permissible under the personnel law applicable to such person and to other party to the marriage and that there are other grounds for doing so, exempt any persons from the operation of these rules.

  1. Training and Departmental Examination.- Every Government servant shall undergo such training or pass such Departmental Examination as may be prescribed from time to time.

(a) Notwithstanding anything contained in these Rules, the Governor of Mizoram in public interest, have the right and power to transfer any Officer or Official recruited in accordance with these Rules to the post/posts/service specified in schedule/Annexure to these rules to any other post or position which is equivalent in rank or grade.

  1. Power to relax.- Where the Governor is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing in consultation with the selection Committee/Departmental Promotion Committee through the Department of Personnel and Administrative Reforms relax any of the provisions and these Rules with respect to any class or category of persons. ,
  2. Reservation, other concessions.- Nothing in these rules shall affect reservation and other concessions required to be provided for the Schedule caste, the Schedule Tribes and other categories of persons in accordance with the orders issued by the Central Government or Government of Mizoram from time to time in this regards.
  3. Repeal and Saving.- All Rules pertaining to these posts framed by the Governor of Assam or by the Government of Assam and were in force in the erstwhile Mizo District and continued to be in existence in pursuance of Government of India, Ministry of Home Affairs Notification No. 14/21/71-HMP (ii) dated 21.1.1972 and Government of Mizoram's Notification No. A.12018/73/80-APT (B) dated 23.4.1992 published in the Mizoram Gazette Volume XXI dated 29.4.1992 Issue No. 67 in respect of the post of Sub-Divisional Agriculture Engineer-Mechanic are hereby repealed.

Provided that any order made or anything done or any action taken under the rules so repealed or under any general orders ancillary thereto, shall be deemed to have been made, done or taken under the corresponding provisions of these rules.

PROMOTION : From Foreman (Mech.)/ Junior Engineer (Mechanic) under Agriculture Department having minimum qualification of Diploma, in Mechanical Engineering from recognised Institute with minimum of 5 (five) years regular service in the grade.

TRANSFER ON DEPUTATION/ CONTRACT : Officers from Central/ States/ U.Ts Admns holding analogous post having qualification of B.E. Mech with a least 2 (two) years regular service in the grade. (Period of deputation/contract will ordinarily be not exceeding 2 (two) years.

MPSC/ SC/ DPC as constituted by the Government from time to time. As per MPSC (Limitation off functions) Regulations 1989 as amended from time to time.
