Notification No. B 13016/8/88-EDN, dated 5th May, 1989. - Whereas the Government of Mizoram deem it expedient to extent the facilities of free tuition to de-reserving Scheduled Castes and Scheduled Tribes students in an recognised institutions in the State of Mizoram ; and
Whereas the Government deems it necessary to reimburse the loss or fee income for such remission of tuition fees to the recognised institution in Mizoram ;
Now, therefore, the Governor of Mizoram is pleased to frame the following rules for regulation of Fee Compensation Grants to the recognised Institution in Mizoram, as follows:
- Short title, extent and commencement.- (1) These Rules may be called The Amended Mizoram Aided Schools Fee Compensation Grants Rules, 1989.
(2) It shall extent to the whole of Mizoram.
(3) It shall come into force at once.
- Definitions.- In these rules, unless the context otherwise requires,-
(a) "Annual Income" means the aggregate of income of any person from all sources during the period of twelve months beginning with the first day of January of that year;
(b) "Department" means the Department of Education and Human Resources Department;
(c) "Director" means the Director of School Education, Mizoram ;
(d) "Fees" means fees at the Government approved rates charges by a recognised institution for imparting tuition to its students ;
(e) "Fee Compensation Grants" means Recurring Grants-in-aid given to an educational institution for compensating loss of fees income due to exemption from payment of tuition fees by the eligible Scheduled Castes and Scheduled Tribes students under these Rules ;
(f) "Government" means the Government of Mizoram ;
(g) "Head of Institution" means the Principal Academic Officer of an Institution, no matter by what name he may be designated ;
(h) "Institution" means any other educational institution/school in Mizoram recognised by the Government.
- Eligibility.- (1) Only the Government aided institutions in Mizoram be eligible for the Fees Compensation Grants; provided that such institutions do not charge rates of tuition fees higher than those charges in corresponding classes of Government Institutions in Mizoram.
(2) Only institutions, imparting secular education shall be entitled to Fee Compensation Grants.
(3) Fee Compensation Grants may be withheld or withdrawn by the Government if the students and/or the teachers or the institutions are found guilty of any serious indiscipline such as resorting to strike or disobeying Government orders.
(4) Any institution found to have preferred false claim or to have reported false enrolment figure shall be liable to forfeit loss of the privilege of Fee Compensation Grants.
(5) No institution shall be eligible to claim Fee Compensation Grant in respect of any student who has been detained in one class for more than one year.
(6) Fees Compensation Grant shall be chargeable by an institution only in respect of these Scheduled Castes and Scheduled Tribes students of the institution the joint annual income of whose parent/guardians are not more than Rs. 80,000 (Rupees eighty thousand).
(7) The students who are in receipt of Central Scholarship the value of which includes tuition fees, shall not be eligible for the fee concession.
- Procedure.- (1) The Head of the Institution claiming fee compensation shall prepare a list all eligible Scheduled Castes/Scheduled Tribes student in the various classes of the Institutions as on 1st April of each year and calculate tuition fees chargeable from them at the approved rates for twelve months commencing from first of April up to the end of that Financial year (namely 31st March of the next calendar year). The statement should clearly mention the name of students, the names of their parents/guardians, the rate at which tuition fee is chargeable against them, the joint annual income of their parents, and the total amount of loss on each student for the months of January to December as also the granted total of loss of fee income to the Institution for these months. Along with the statement indicated above each head of an institution shall furnish another statement showing total charge of enrolment position class-wise and month-wise during the previous twelve months on part of that year, dropping for the purpose of this statement for more than 45 (forty five) days at a time except on medical ground. On the basis of these statements he shall prepare a financial statement in terms of tuition fees and shall make such deduction or addition to his claim for the fee compensation grants for the current year, as may become necessary in view of the charges in the position during the previous twelve (12) months.
(2) The Additional District Education Officer and the Sub-Divisional Education Officer after consolidating the claims received from various schools and taking into account any adjustment due to changes of enrolment figures during the previous twelve months will prepare statement in duplicate showing the total financial involvement on account of fee compensation showing the total financial involvement on account of the fee compensation grants and send one copy of the same to the District Education, Officer, and other to the Director of School Education so as to reach them not later than 15th May of each year. On receipt of basic materials the District Education Officer will prepare concrete and consolidated proposal for sanction of money to meet the expenditure on account of fee compensation in respect of the Middle and High Schools and requirements for each school. The proposal must reach the Director of Schools Education not later than 15th June each year. On the basis of materials received from the District Education Officer, the Director shall make necessary proposal to the Government for sanction of funds to meet expenditure on account of Fee Compensation Grants as early as possible and on receipt of finance concurrence shall allot funds to the District Education Officer/Sub-Divisional Education Officer for disbursement to the various institutions.
- Rate of tuition fees.- Subject to the provisions of Rule 6, the rate of tuition fees for Schools of Mizoram may be fixed as follows :
(i) | Class VII | Rs. 10 per month |
(ii) | Class IX and X | Rs. 15 per month |
- Residuary matters.- The Director shall have the right to make any addition or alteration in the procedural details given above, in case he feels satisfied that such changes are conducive to better results.
- Repeal and savings.- (1) The Mizoram Fee Compensation Grant Rules, 1976 is hereby repealed.
(2) Notwithstanding such repeal, any action taken or purported to have been taken under the rules so repealed shall be deemed to have been taken or purported to have been taken under these rules.
