Jammu & Kashmir Industrial Establishments (National & Festival) Holidays Rules, 1977

In exercise of the powers conferred by section 12 of the Jammu and Kashmir Industrial Establishments (National and Festival) Holidays Act, 1974 (XIII of 1974) the Governor hereby make the following rules, namely:-

  1. Short title— (1) These rules may be called the Jammu and Kashmir Industrial Establishments (National and Festival) Holidays Rules, 1977.

(2) They shall come into force with effect from the date these are published in the Government Gazette.

  1. Definitions— In these rules, unless the context otherwise requires,—

(a) 'Act' means the Jammu and Kashmir Industrial Establishments (National and Festival) Holidays Act, 1974.

(b) 'Form' means a Form appended to these rules;

(c) 'Inspector' means a person appointed as such under sub-section (1) of section 6;

(d) 'Section' means section of the Act.

  1. Festival Holidays— (1) The four festival holidays required to be allowed under sub-section (1) of section 3 of the Act in each calender year shall be determined by the Inspector before 31st December each year. Unless otherwise ordered by the Inspector in consultation with the employer and employees, the holidays may be chosen from the following namely:

  3. Baisakhi
  4. Janam Ashtami
  5. Holi
  6. Guru Gobind Singh's Birthday
  7. Guru Nanak's Birthday
  8. Dussehra
  9. Idul Fitr
  10. X-Mas
  11. Muharram
  12. Guru Ravi Dass Birthday
  13. Shivratri
  14. Good Friday
  15. Mahavir Jayanti
  16. Guru Hargobind Singh's Birthday
  17. 1st May
  18. Shab-i-Barat
  19. Id-e-Milad
  20. Shab-i-Qadar
  21. Id-ul-Zuha
  22. Vishwa Karama Day
  23. Budha Purnima

(2) The holidays determined under sub-rule (1) above shall be notified by the Inspector in the Form appended to these rules, to the employer who shall exhibit the same at a conspicuous place in the premises.
