Revenue & Land Reforms Department, Notification No.-4/Estt.C.I.-16/ 2002-326(4)/. - G.S.R. - In exercise of the powers conferred by the provision of Article 309 of the Constitution of India, the Governor of Bihar is pleased to repeal all previous orders and to make the following Rules to regulate the mode of recruitment and service conditions of circle Inspectors-cum-Kanoongoes :-
- Short Title, Extension and Commencement.- (i) These Rules may be called "The Bihar Junior Revenue Services Cadre Rules, 2004".
(ii) It shall extend to the entire State of Bihar.
(iii) It shall come into force with immediate effect from the date of publication in the Bihar Gazette.
- Definitions.- Unless there is something repugnant on the subject or context for the purpose of these Rules -
(a) "State Government" means the State Government of Bihar;
(b) "Commission" means the Bihar Staff Selection Commission;
(c) "Service Cadre" means the Junior Revenue Service Cadre;
(d) "Department" means the Revenue and Land Reforms Department;
(e) "Appointing Authority" means the Commissioner and Secretary/Secretary, Revenue & Land Reforms Department;
(f) "Rules" means The Bihar Junior Revenue Service Cadre Rules of the Revenue and Land Reforms Department of Bihar.
- Designation and level of Cadre.- (i) This service cadreincludes all Circle Inspectors-cum-Kanoongoes appointed under the administrative control of Revenue & Land Reforms Department.
(ii) Posts of the Cadre shall be of non-gazetted class-III.
(iii) The Cadre shall be of State level.
- Cadre Strength and Pay Scale.- (i) The total strength of the post of the Cadrewill be that of the presently sanctioned/borne by State Government and sanctioned/borne by the State Government thereafter.The State Government shall be competent to make changes in the number of posts in the Service Cadre, as necessary.
(ii) At present the sanctioned Pay scale of the posts of the Cadre is Rs. 5000-150-8000. The revision in the scale of pay may be done by the State Government from time to time.
- Mode of recruitment; age limit and other requisites etc.- (i) Direct appointment on fifty per centof the post out of the total sanctioned strength of the service Cadre shall be made on the recommendation of the Candidates recommended by the Bihar Staff Selection Commission and on the rest fifty per cent posts, appointment by promotion on the recommendation of the Departmental Promotion Committee constituted under the Chairmanship of Commissioner and Secretary/Secretary, Revenue & Land Reforms Department.
(ii) Direct appointment and appointment by promotion on the posts of Service Cadre, shall be made by the Commissioner and Secretary/Secretary, Revenue and Lands Reforms Department. The appointments, postings, transfers, Confirmation in service, preparation and maintenance of seniority list of the members, promotion and all matters relating to establishment shall be under the control of Commissioner and Secretary/Secretary, Revenue & Land Reforms Department.
- Direct Appointment.- (1)(i) Direct appointment on the fifty percentof the vacancy of the cadre will be made from the list of successful candidates prepared on the basis of competitive examination conducted by the Commission.
(ii) Intimation of the vacancy occurred in any calendar year shall be sent to the Commission in the month of January of every year.
(iii)The select list sent by the Commission shall be legally valid for a period of one year.
(2) Age limit : The minimum age of a candidate for direct recruitment shall not be less than Eighteen years on the first January of the year inviting application. Maximum age limit shall be that which may be fixed by the State Government (Personnel and Administrative Reforms Department) from time to time.
(3) Educational Requisites and Syllabus for Competitive Examination :
(i) For direct appointment to the cadre it shall be compulsory for the candidate to be a Bachelor degree holder from any recognized University.
(ii) Candidates shall be required to appear in two compulsory subjects i.e., Hindi and General Knowledge and two optional subjects. Each paper shall be of three hours duration and each paper shall carry full marks of one hundred. It shall be essential to secure a minimum thirty per cent marks in Hindi subject and this subject shall only be a qualifying subject. Reservation/category-wise merit list shall be prepared on the basis of the marks obtained in the rest three subjects.
(4) Physical Fitness : Unless the candidate is able to produce a Medical Certificate of fitness issued by the Competent Medical Officer that he is fit to discharge duties physically and mentally in efficient manner, his joining shall not be accepted at departmental level. Similarly the antecedents of the candidate will be required to be verified by the police and after submission of Police enquiry report, Joining shall be accepted.
- Confirmation in service.- May be confirmed, on the completion of two years of satisfactory prescribed period of probation, provided that -
(i) has passed the prescribed Departmental examination;
(ii) character and duties being found satisfactory;
(iii) of absolute integrity and devoted to duties; and
(iv) the appointing authority is satisfied that he/she is fit to be confirmed on the post held.
- Appointment by promotion.- (i) On the fifty per centof vacancy of the total cadrestrength Only Bachelor degree holders from Rajasva Halka Karmacharis cadre shall be appointment by promotion.
(ii) The minimum tenure fixed for promotion on the cadre post shall be in accordance with the Personnel and Administrative Department's Resolution Number 280 dated 5.7.2002 and revisions from time to time.
(iii) It shall be compulsory to come out successful in the Departmental examination conducted by the Revenue Department.
(iv) Final selection of Rajasva Halka Karmacharis for promotion shall be made in the light of the recommendation made by the Departmental Promotion Committee on the basis of reservation category-wise inter-se-seniority-cum-merit.

- Appointing Authority.- The Commissioner and Secretary/Secretary, Revenue and Land Reforms Department, Bihar shall be the Appointing Authority of the members of this Cadre.
- Posting procedure.- In course of posting of a member of the Cadre, the Commissioner and Secretary/Secretary, Revenue and Land Reforms Department, Government of Bihar, according to the requirement of Muffasil Revenue Offices shall place the services of the member for a maximum period of six yearsunder the different Divisional Commissioner and under Directors of different Directorates e.g. Land Records & Surveys, Land Acquisition, Consolidation etc. functioning under the administrative control of the Revenue and Land Reforms Department, who shall post, transfer and depute a member in different Revenue Offices falling under their jurisdiction. The Commissioner and Secretary/Secretary, Revenue and Land Reforms Department, Government of Bihar shall be competent to make transfer, posting and deputation of a member of this Cadre even prior to completion of six years term in the public interest and on administrative grounds. The tenure of posting of members of theCadre at one place shall be of three years.
- Seniority.- The seniority list of the Service Cadreshall be prepared on the basis of Resolution No. 15784 of Personnel and Administrative Reforms Department's dated 26.8.1972 and instructions issued by the Government from time to time in this regard and shall be maintained at the State level by the Revenue and Land Reforms Department.
- Discipline and appeal.- The rules applicable to the other personnel of the State Government shall apply mutatis mutandisfor the members of this cadre also.
- Those subjects/points which could not be provided in these Rules, the provisions made in this regards in other relevant Codes/Rules/Resolutions/Instructions of the State Government shall be applicable mutatis mutandis.
- Reservation.- The provisions of Reservation Act/Rules/Resolution/Instruction with respect to appointment/promotion shall apply mutatis mutandisfor this Cadre also.
- Savings and Repeal.- Rules/Instruction etc. issued prior to it may deemedto berepealed in this regard. Notwithstanding such repeal, anything done or any action taken under those Rules/Instructions etc. shall be deemed to have been done under these Rules.
