G.S.R. 257(E). - In exercise of the powers conferred by section 87 of the Punjab Re-organisation Act, 1966 (31 of 1966), the Central Government hereby extends to the Union territory of Chandigarh, the Punjab Panchayati Raj (Amendment) Act, 1998 (Punjab Act No. 15 of 1998), as in force in the State of Punjab on the date of this notification, subject to the following modifications, namely :-

Modifications

  1. In sub-section (1) of section 1, for the words brackets and figures "the Punjab Panchayati Raj (Amendment) Act, 1998", the words, brackets and figures "the Punjab Panchayati Raj (Amendment) Act, 1998, as extended to the Union territory of Chandigarh", shall be substituted.
  2. In section 2, for the words and figures, "In the Punjab Panchayati Raj Act, 1994", the words and figures, "In the Punjab Panchayati Raj Act, 1994, as extended to the Union territory of Chandigarh" shall be substituted.

Annexure

An Act further to amend the Punjab Panchayati Raj Act, 1994

Be it enacted by the Legislature of the State of Punjab in the Forty-ninth Year of the Republic of India as follows :-

  1. Short title and commencement.- (1) This Act may be called the Punjab Panchayati Raj (Amendment) Act, 1998.

(2) It shall come into force at once.

  1. Amendment of Section 2 of Punjab Act 9 of 1994.- In the Punjab Panchayati Raj Act, 1994 (hereinafter referred to as the Principal Act), in section 2, in clause (zn), for the words, "the population as" the words "the rural population as" shall be substituted.
  2. Amendment of Section 12 of Punjab Act 9 of 1994.- In the principal Act, in section 12, in sub-section (4), for the words "Gram Panchayat", the words "Gram Panchayats at the time of every general election" shall be substituted.
  3. Amendment of Section 99 of Punjab Act 9 of 1994.- In the principal Act, in section 99, in sub-section (1),-

(i) in clause (a), for the words "six to ten", the words "fifteen to twenty-five" shall be substituted; and

(ii) clause (b) and the proviso thereto shall be omitted.

  1. Amendment of Section 100 of Punjab Act 9 of 1994.- In the principal Act, in section 100,-

(i) for the words, "every fifteen thousand population", the words, "every six thousand population" shall be substituted; and

(ii) in the first proviso, in the second line, for the word "Six", the word "fifteen" shall be substituted and in the fifth line, for the word "ten", the words, "twenty-five" shall be substituted.

  1. Amendment of Section 107 of Punjab Act 9 of 1994.- In section 107,-

(i) In the heading, the words "after each census" shall be omitted; and

(ii) for the words, "and rotation for reservation of seats and offices for different categories shall be determined on the basis of population of the Panchayat Samiti area at that census", the words "for reservation of seats and offices for different categories shall be determined on the basis of population of Panchayat Samiti area at that census and rotation of seats and offices shall be made at the time of every general election" shall be substituted.

  1. Amendment of Section 170 of Punjab Act 9 of 1994.- In the principal Act, in section 170, the words "after each census" wherever occurring shall be omitted.
