Government of Bihar, Food and Consumer Protection Department, Notification, No. 1841, dated 1.6.2007. - In exercise of powers, conferred under proviso to Article, 309 of Constitution of India the Governor of Bihar is pleased to make the following Rules regarding service conditions of Supply Inspectors:-

  1. Short title, extent and commencement.- (i) This Rule may be called "Bihar Supply Service Rules, 2007".

(ii) It extends to the whole of the State of Bihar.

(iii) It shall come into force immediately.

  1. Definitions.- In this Rule unless the context otherwise requires:-

(i) "State Government" means the Government of the State of Bihar.

(ii) "Appointing Authority", means Principal Secretary/Commissioner and Secretary/Secretary, Food and Consumer Protection Department.

(iii) "Cadre Controlling Authority;" means Food and Consumer Protection Department of the Government of Bihar.

(iv) "Department", means Food and Consumer Protection Department of the Government of Bihar.

(v) "Commission", means Bihar Staff Selection Commission.

(vi) "Service", means Bihar Supply Service.

(vii) "Appendix" means- Appendix annexed with this Rule.

  1. Service/Cadre Formation.- (1) There shall be following category in this service/cadre.

(i) Supply Inspector.

(ii) Marketing Officer.

(iii) Assistant District Supply Officer.

(iv) District Supply Officer.

(2) Prior to formation of this Rule the existing personnel in the said category shall be automatically included in the cadre.

  1. Sanctioned Strength.- (I) The present strength of this service is as follows but the service strength shall be revised from time to time as per requirement by creation and abolition of posts in this cadre-
(i) Supply Inspector - 611
(ii) Marketing Officer - 316
(iii) Assistant District Supply Officer - 36
(iv) District Supply Officer - 12

(II) The cadre controlling Authority under sub-rule-1 shall identify the post at different district and sub-division level according to sanctioned service strength of the cadre.

(III) All personnel of Supply Inspector cadre and working on the post of Supply Inspector, Marketing Officer, Assistant District Supply Officer and District Supply Officer shall be considered member of this service.

  1. Reservation.- The provision of reservation/roster shall be applicable in the appointment/promotion in the service/cadre from time to time fixed by the State Government.
  2. Recruitment in the Service.- (I) The post of Supply Inspector shall be filled at the entrance point in the service on which the recruitment shall be done on the recommendation of Commission. Requisition for the vacancies of every calendar year shall be sent to Commission. The eligibility of age shall be on the basis of 1st January.

(a) 75% post of Supply Inspector shall be filled up by direct recruitment.

(b) 25% post of Supply Inspector shall be filled up by promotion/appointed through limited competitive examination.

(II) The Educational qualification and eligibility as well as the recruitment process shall be according to sub-clause of Appendix-I. The cadre controlling authority shall by notification make amendments from time to time in the said provisions of the Appendix.

  1. Probation Period.- Recruited Supply Inspector, under Rule-6 shall be declared probationer from the date of appointment. Probation period shall be of two years which may be extended for one year in case the service and conduct is not found satisfactory. During extended period of probation if the service is not satisfactory, the appointed probationer Supply Inspector may be discharged from the service.
  2. Departmental Examination/Confirmation.- (1) After satisfactory completion of probation period, prescribed training and after passing the departmental examination, the service shall be confirmed; but this rule shall not be applicable in case of already appointed and working officers prior to the commencement of this Rule and they shall not be required to pass departmental examination and under go requisite training.

(2) The department shall prescribe the syllabus for the departmental examination by a separate notification.

  1. Training.- During probation period every personnel shall compulsorily participate in training conducted by Bihar Public Administration and Rural Development Institute (Bipard) Walmi, Phulwarisharif, Patna.
  2. Increment.- After appointment the first and subsequent increment shall be sanctioned after passing the Hindi noting and drafting examination conducted by the Raj Bhasha Department.
  3. Promotion.- (i) The promotional avenue for the confirmed personnel in the service shall be in the following manner:-

(a) From the Supply Inspector to the post of the Marketing Officer.

(b) From the Marketing Officer to the post of Assistant District Supply Officer.

(c) From Assistant District Supply Officer to the post of District Supply Officer.

(ii) The promotion shall be considered according to the Merit cum Seniority on the basis of recommendation of departmental promotional committee.

(iii) The promotion shall be considered after completion of fixed and revised Kalawadhi from time to time as per resolution no. 280 dated 05.07.02 of Personnel and Administrative Reforms Department.

  1. Seniority.- The seniority shall be decided on the basis of marks obtained and recommended merit list in the examination conducted by the Commission for the appointment of Supply Inspector.
  2. If there is any confusion in the interpretation of any provision of this Rule, the decision of department shall be final.
  3. The power to make regulation.- To make the provision of this Rule effective the department may make regulation as per requirement.
  4. Repeal and Savings.- From the date of commencement of this Rule the Supply Inspector Cadre Recruitment Rule, 1993, shall stand repealed notwithstanding such repeal any thing done or any action taken under said Rule, shall be deemed to have been done or taken under the corresponding provision of this Rule, as if the said rule was effective on the day when such work and action had been implemented.

5. Minimum & Maximum Age for Direct Recruitment : Minimum Age-21 yrs. Maximum Age-Maximum shall be the same which is fixed from time to time by the State Government (Personnel & Administrative Reforms Department.)
6. Minimum Qualification for the Direct Recruitment. : Graduate Degree from recognised University.
7. Minimum Qualification for the appointment from limited competitive examination-
(i) Working in the lower pay scale then the regular pay scale of Supply Inspector.
(ii) Age shall not be more than 45 yrs. on the date of application (1st January of the applying year).
(iii) 10 years of service should be completed under State Government Service on the date of application.
(iv) Passed out from the recognised University.
8. Training : During probation period it is essential to participate in the training programme conducted by Bihar Public Administration and Rural Development. Institution (Bipard) Walmi, Phulwarishariff, Patna. Training curriculum shall be prepared on the basis of reciprocal conversation between Food and Consumer Protection Department and Bipard itself.
9. Departmental promotional committee-D.P.S. shall be constituted in following manner-
(a) Principal Secretary/Commissioner and Secretary/Secretary, Food & Consumer Protection Deptt. - Chairman
(b) Establishment Incharge, Deputy/ Undersecretary - Member/Secretary
(c) Other, Deputy/ Under Secretary - Member
(d) Nominated Schedule Caste/ Schedule Tribe representative by Personnel & Administrative Reforms Department. -Member
